  1  1    Section 1.  NEW SECTION.  261C.10  PAYMENT OF SCHOOL
  1  2 DISTRICT CLAIMS – APPROPRIATION.
  1  3    1.  If the general assembly appropriates funds to the
  1  4 department of education for the payment of school district
  1  5 postsecondary enrollment options costs, a school district that
  1  6 paid a tuition reimbursement amount as provided in section
  1  7 261C.6 may submit a claim to the department, on forms provided
  1  8 by the department, for reimbursement of the amount paid to the
  1  9 eligible postsecondary institution.  Claims submitted to the
  1 10 department shall state the actual costs incurred.  Claims
  1 11 shall be accompanied by an affidavit of an officer of the
  1 12 school district affirming the accuracy of the claim.
  1 13    2.  From the moneys appropriated in subsection 4, taking
  1 14 into consideration the relative budget and cash position of
  1 15 the state resources, the department shall certify to the
  1 16 department of revenue and finance, by February 1 and on or
  1 17 about June 15, the amounts of approved claims to be paid, and
  1 18 the department of revenue and finance shall draw warrants
  1 19 payable to school districts with approved claims.
  1 20    3.  Payments made to a school district under this section
  1 21 are miscellaneous income for purposes of chapter 257.
  1 22    4.  There is appropriated from the general fund of the
  1 23 state to the department of education for each fiscal year the
  1 24 sum of one million seven hundred thousand dollars for the
  1 25 payment of school district postsecondary enrollment options
  1 26 costs.
  1 27    5.  If the director of the department of education
  1 28 determines that the moneys appropriated by the general
  1 29 assembly as provided in subsection 4 are insufficient to pay
  1 30 in full all claims submitted in accordance with this section,
  1 31 the amounts of approved claims to be paid shall be prorated
  1 32 among all school districts with approved claims.
  1 33    6.  The state board of education shall adopt rules pursuant
  1 34 to chapter 17A to implement this section.  
  1 35                           EXPLANATION 
  2  1    This bill appropriates $1.7 million annually to the
  2  2 department of education for the payment of claims submitted to
  2  3 the department by school districts for reimbursement of the
  2  4 amounts the districts paid to postsecondary institutions in
  2  5 accordance with the postsecondary enrollment options Act.
  2  6    Claims submitted to the department shall state the actual
  2  7 costs incurred, and shall be accompanied by an affidavit of an
  2  8 officer of the public school district affirming the accuracy
  2  9 of the claim.
  2 10    The bill requires the department to certify to the
  2 11 department of revenue and finance, by February 1 and on or
  2 12 about June 15, the amounts of approved claims to be paid, and
  2 13 the department of revenue and finance shall draw warrants
  2 14 payable to school districts with approved claims.
  2 15    If the director of the department of education determines
  2 16 that the moneys appropriated by the general assembly are
  2 17 insufficient to pay in full all claims, the amounts paid shall
  2 18 be prorated among all school districts with approved claims.
