  1  1    Section 1.  NEW SECTION.  256.24  ADVANCED PLACEMENT
  1  2 INCENTIVE GRANT PROGRAM.
  1  3    1.  An advanced placement incentive grant program is
  1  4 established under the control of the department of education.
  1  5    2.  The department shall approve and administer grants
  1  6 annually to accredited public and nonpublic secondary schools,
  1  7 which graduate students who have achieved advanced placement
  1  8 status through taking advanced placement courses and
  1  9 examinations, as determined by the college entrance
  1 10 examination board, as follows:
  1 11    a.  A grant of not more than one hundred dollars for each
  1 12 graduating student who achieves advanced placement scholar
  1 13 status.
  1 14    b.  A grant of not more than two hundred dollars for each
  1 15 graduating student who achieves advanced placement scholar
  1 16 with honors status.
  1 17    c.  A grant of not more than three hundred dollars for each
  1 18 graduating student who achieves advanced placement scholar
  1 19 with distinction status.
  1 20    3.  The department shall approve and administer grants
  1 21 annually to accredited public and nonpublic secondary schools
  1 22 that deliver an advanced placement course and instruction
  1 23 through the Iowa communications network as follows:
  1 24    a.  A grant of not more five hundred dollars if fifty
  1 25 percent or more of the school's students taking advanced
  1 26 placement examinations earn advanced placement scores of three
  1 27 point zero or greater.
  1 28    b.  A grant of not more one thousand dollars if sixty
  1 29 percent or more of the school's students taking advanced
  1 30 placement examinations earn advanced placement scores of three
  1 31 point zero or greater.
  1 32    c.  A grant of not more one thousand five hundred dollars
  1 33 if seventy percent or more of the school's students taking
  1 34 advanced placement examinations earn advanced placement scores
  1 35 of three point zero or greater.
  2  1    4.  Grant moneys received in accordance with this section
  2  2 shall be used for purposes of acquiring or maintaining
  2  3 materials, educational resources, and technology for advanced
  2  4 placement instructors and advanced placement courses, and to
  2  5 reimburse licensed secondary teachers for tuition costs for
  2  6 attendance at conferences and institutes for the purpose of
  2  7 creation or maintenance of advanced placement courses.
  2  8    5.  The board of directors of a school district and the
  2  9 authorities in charge of an accredited nonpublic school may
  2 10 apply to the department on behalf of a secondary school that
  2 11 meets the requirements of subsection 2 or 3, on forms provided
  2 12 by the department, to receive a grant under this program.  By
  2 13 July 1, the department shall review each application and award
  2 14 grants to secondary schools for program requirements met
  2 15 during the previous fiscal year.
  2 16    6.  Grant moneys received under this section shall not be
  2 17 commingled with state aid payments made under section 257.16
  2 18 to a school district and shall be accounted for by the school
  2 19 district separately from state aid payments.  Payments made to
  2 20 school districts under this section are miscellaneous income
  2 21 for purposes of chapter 257.  Each school district and
  2 22 accredited nonpublic school shall maintain a separate listing
  2 23 within its budget for payments received and expenditures made
  2 24 pursuant to this section and shall provide the listing to the
  2 25 department upon request.
  2 26    7.  There is appropriated from the general fund of the
  2 27 state to the department of education, the sum of five hundred
  2 28 thousand dollars for the purpose of awarding grants as
  2 29 provided in this section.  If the funds appropriated by the
  2 30 general assembly are not sufficient to award grants to each of
  2 31 the accredited public and nonpublic schools that meet the
  2 32 requirements of this section, grant amounts shall be prorated
  2 33 on the basis of the funds appropriated.
  2 34    8.  Notwithstanding section 8.33, unencumbered or
  2 35 unobligated funds remaining on June 30 of the fiscal year for
  3  1 which the funds were appropriated shall not revert but shall
  3  2 be available for expenditure for the following fiscal year for
  3  3 the purposes of this section.
  3  4    9.  For purposes of this section, "advanced placement"
  3  5 means a college-level course offered by a secondary school
  3  6 using curriculum provided by the college entrance examination
  3  7 board, and "advanced placement examination" means an advanced
  3  8 placement examination provided by the college entrance
  3  9 examination board.  The examinations are administered by
  3 10 secondary schools to students participating in advanced
  3 11 placement classes and the examination grades are rated on a
  3 12 scale provided by the college entrance examination board.
  3 13    Sec. 2.  NEW SECTION.  261.20A  IOWA ADVANCED PLACEMENT
  3 14 SCHOLARSHIP PROGRAM.
  3 15    1.  The college student aid commission shall prepare and
  3 16 administer an Iowa advanced placement scholarship program for
  3 17 Iowa resident students who graduate from an accredited Iowa
  3 18 public or nonpublic secondary school and who successfully
  3 19 complete a minimum of three college entrance examination board
  3 20 advanced placement examinations during the period specified by
  3 21 the commission.  Scholarships awarded under this section shall
  3 22 provide assistance to an individual enrolled in a community
  3 23 college as defined in section 260C.2, an institution of higher
  3 24 learning under the control of the state board of regents, or
  3 25 an accredited private institution as defined in section 261.9.
  3 26 The program shall include the following four scholarship
  3 27 levels:
  3 28    a.  An advanced placement scholar award for each graduating
  3 29 secondary school student who completes a minimum of three
  3 30 college entrance examination board advanced placement
  3 31 examinations with a score of three point zero or greater on
  3 32 each full-year examination based upon criteria established by
  3 33 the college entrance examination board.  An individual who
  3 34 meets the qualifications of this paragraph shall receive a
  3 35 scholarship amount of five hundred dollars.
  4  1    b.  An advanced placement scholar with honors award for
  4  2 each graduating secondary school student who completes a
  4  3 minimum of four college entrance examination board advanced
  4  4 placement examinations with a score of three point zero or
  4  5 greater on each full-year examination based upon criteria
  4  6 established by the college entrance examination board, and who
  4  7 has an average examination grade of three point twenty-five or
  4  8 greater based upon criteria established by the college
  4  9 entrance examination board.  An individual who meets the
  4 10 qualifications of this paragraph shall receive a scholarship
  4 11 amount of one thousand dollars.
  4 12    c.  An advanced placement scholar with distinction award
  4 13 for each graduating secondary school student who completes a
  4 14 minimum of five college entrance examination board advanced
  4 15 placement examinations with a score of three point zero or
  4 16 greater on each full-year examination based upon criteria
  4 17 established by the college entrance examination board, and who
  4 18 has an average examination grade of three point five or
  4 19 greater based upon criteria established by the college
  4 20 entrance examination board.  An individual who meets the
  4 21 qualifications of this paragraph shall receive a scholarship
  4 22 amount of one thousand five hundred dollars.
  4 23    d.  An advanced placement state scholar award to be awarded
  4 24 to one male and one female graduating secondary school student
  4 25 who completes the greatest number of full-year college
  4 26 entrance examination board advanced placement examinations and
  4 27 who has an average examination grade of three point five or
  4 28 greater based upon criteria established by the college
  4 29 entrance examination board.  The individuals who meet the
  4 30 qualifications of this paragraph and who are chosen to receive
  4 31 a scholarship in accordance with this paragraph shall each
  4 32 receive a scholarship amount of two thousand dollars.
  4 33    2.  To be eligible to receive a scholarship as provided in
  4 34 subsection 1, an applicant shall meet the following initial
  4 35 requirements:
  5  1    a.  Complete and file an application determined by the
  5  2 commission for a scholarship.
  5  3    b.  Report promptly to the commission any information
  5  4 requested.
  5  5    c.  Complete requirements for the secondary school diploma
  5  6 or its equivalent by the end of the summer preceding entrance
  5  7 into college.
  5  8    d.  Enroll as a full-time student at a community college as
  5  9 defined in section 260C.2, an institution of higher learning
  5 10 under the control of the state board of regents, or an
  5 11 accredited private institution as defined in section 261.9.
  5 12    3.  The commission shall adopt rules pursuant to chapter
  5 13 17A to administer this section.  The commission may provide
  5 14 for proration of scholarship amounts if the available funds
  5 15 are insufficient to pay all approved scholarships.  Such
  5 16 proration shall take primary account of the financial need of
  5 17 the applicant.  In determining who is a resident of Iowa, the
  5 18 commission's rules shall be at least as restrictive as those
  5 19 of the state board of regents.
  5 20    4.  There is appropriated from the general fund of the
  5 21 state to the college student aid commission the sum of five
  5 22 hundred thousand dollars for the purpose of awarding
  5 23 scholarships as provided in this section.
  5 24    5.  Notwithstanding section 8.33, unencumbered or
  5 25 unobligated funds remaining on June 30 of the fiscal year for
  5 26 which the funds were appropriated shall not revert but shall
  5 27 be available for expenditure for the following fiscal year for
  5 28 the purposes of this section.
  5 29    6.  For purposes of this section, "advanced placement"
  5 30 means a college-level course offered by a secondary school
  5 31 using curriculum provided by the college entrance examination
  5 32 board, and "college entrance examination board advanced
  5 33 placement examination" means an examination provided by the
  5 34 college entrance examination board, and administered by a
  5 35 secondary school to a student participating in an advanced
  6  1 placement class with the examination grade rated on a scale
  6  2 provided by the college entrance examination board.
  6  3    Sec. 3.  EMERGENCY RULES.  The department of education and
  6  4 the college student aid commission may adopt emergency rules
  6  5 under section 17A.4, subsection 2, and section 17A.5,
  6  6 subsection 2, paragraph "b", to implement the provisions of
  6  7 this Act and the rules shall be effective immediately upon
  6  8 filing unless a later date is specified in the rules.  Any
  6  9 rules adopted in accordance with this section shall also be
  6 10 published as a notice of intended action as provided in
  6 11 section 17A.4.
  6 12    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  6 13 immediate importance, takes effect upon enactment.  
  6 14                           EXPLANATION 
  6 15    This bill establishes an advanced placement incentive grant
  6 16 program under the control of the department of education,
  6 17 permits school districts to use grant moneys to acquire or
  6 18 maintain materials, educational resources, and technology for
  6 19 advanced placement instructors and courses, and to pay
  6 20 teachers for additional instructional work assignments
  6 21 including attendance at conferences and institutes for the
  6 22 purpose of creation or maintenance of advanced placement
  6 23 courses; directs the college student aid commission to prepare
  6 24 and administer an Iowa advanced placement merit scholarship
  6 25 program; and appropriates $500,000 from the general fund of
  6 26 the state to the department for purposes of the incentive
  6 27 grant program and $500,000 from the general fund of the state
  6 28 to the commission for purposes of awarding the scholarships.
  6 29    ADVANCED PLACEMENT INCENTIVE GRANT PROGRAM.  The department
  6 30 of education is charged with approving and administering
  6 31 grants annually to accredited public and nonpublic secondary
  6 32 schools which graduate students who have achieved advanced
  6 33 placement.  Grant amounts range from $100 to $300 per
  6 34 graduating student who achieves advanced placement scholar,
  6 35 advanced placement with honors, or advanced placement scholar
  7  1 with distinction status.
  7  2    Under the program, the department is also directed to
  7  3 approve and administer grants annually to accredited public
  7  4 and nonpublic secondary schools that deliver an advanced
  7  5 placement course and instruction through the Iowa
  7  6 communications network.  Grant amounts for these schools range
  7  7 from not more than $500 if 50 percent or more of the school's
  7  8 students taking advanced placement examinations earn advanced
  7  9 placement scores of 3.0 or greater, to a grant of not more
  7 10 than $1,500 if 70 percent or more of the school's students
  7 11 taking advanced placement examinations earn advanced placement
  7 12 scores of 3.0 or greater.
  7 13    Grant moneys can be used by a school to acquire or maintain
  7 14 materials, educational resources, and technology for advanced
  7 15 placement instructors and advanced placement courses, and may
  7 16 also be used to reimburse licensed secondary teachers who
  7 17 attend conferences and institutes for the purpose of creation
  7 18 or maintenance of advanced placement courses.
  7 19    Each school district and accredited nonpublic school
  7 20 receiving grant moneys must maintain a separate listing within
  7 21 their budgets for payments received and expenditures made and
  7 22 must provide the listing to the department upon request.
  7 23    The bill provides that if the funds appropriated by the
  7 24 general assembly are not sufficient to award grants to each of
  7 25 the qualifying accredited public and nonpublic schools, grant
  7 26 amounts shall be prorated.
  7 27    IOWA ADVANCED PLACEMENT MERIT SCHOLARSHIP PROGRAM.  The
  7 28 college student aid commission is directed to prepare and
  7 29 administer an Iowa advanced placement scholarship program for
  7 30 Iowa resident students who graduate from an accredited Iowa
  7 31 public or nonpublic secondary school and who successfully
  7 32 complete a minimum of three college entrance examination board
  7 33 advanced placement examinations during the period specified by
  7 34 the commission.  Scholarships are awarded to provide
  7 35 assistance to an individual enrolled in a community college, a
  8  1 regents university, or an accredited private institution.
  8  2    The program includes four scholarship levels.  Scholarship
  8  3 amounts range from $500 to $2,000.  Applicants must complete
  8  4 three or more college board advanced placement examinations
  8  5 with a score of 3.0 or greater on each full-year examination
  8  6 based upon criteria established by the college board.  The
  8  7 bill provides that the highest level scholarship will be
  8  8 awarded to one male and one female graduating secondary school
  8  9 student who completes the greatest number of full-year college
  8 10 entrance examination board advanced placement examinations and
  8 11 who has an average examination grade of 3.5 or greater based
  8 12 upon criteria established by the college board.
  8 13    The bill permits the commission to provide for proration of
  8 14 scholarship amounts if the funds appropriated are insufficient
  8 15 to pay all approved scholarships.  Proration shall take
  8 16 primary account of the financial need of the applicant.
  8 17    The bill permits the department of education and the
  8 18 college student aid commission to adopt emergency rules, and
  8 19 the bill becomes effective upon enactment.
