1 1 Section 1. NEW SECTION. 613.20 LIABILITY OF GOLF COURSE
1 2 OPERATORS.
1 3 A person owning or operating a golf course, including
1 4 trustees, directors, officers, members, employees, or other
1 5 agents, shall not be held liable for any damages occurring on
1 6 the golf course and related premises resulting from a failure
1 7 to warn of weather-related conditions and phenomena, including
1 8 but not limited to lightning strikes, or the dangers
1 9 associated with such conditions and phenomena. However, this
1 10 section shall not limit the liability of such persons for
1 11 damages resulting from any failure to warn against any other
1 12 dangerous condition on the golf course and related premises,
1 13 to the extent that such persons owe a duty to warn of such
1 14 condition.
1 15 EXPLANATION
1 16 This bill exempts golf course operators from liability for
1 17 damages resulting from an alleged failure to warn of weather-
1 18 related conditions and phenomenon, such as lightning strikes.
1 19 The bill preserves any liability for a failure to warn of any
1 20 other dangerous conditions on the premises, to the extent such
1 21 a duty may exist.
