1 1 Section 1. Section 6B.4, Code 1999, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A compensation commission
1 4 appointed pursuant to this section is a governmental body as
1 5 defined in section 21.2 and its meetings shall be conducted in
1 6 compliance with chapter 21. Notice published by the sheriff
1 7 pursuant to section 6B.11 shall constitute public notice of
1 8 the meeting pursuant to section 21.4.
1 9 Sec. 2. Section 6B.11, Code 1999, is amended to read as
1 10 follows:
1 11 6B.11 FILING OF NOTICES AND RETURN OF SERVICE.
1 12 Notices, immediately after the service thereof, shall, with
1 13 proper return of service endorsed thereon or attached thereto,
1 14 be filed with the sheriff. The sheriff shall at once cause
1 15 the commissioners to be notified of the day and hour when they
1 16 will be required to proceed with the appraisement. The notice
1 17 to the commissioners shall also be published by the sheriff
1 18 pursuant to section 331.305.
1 19 EXPLANATION
1 20 This bill provides that a compensation commission
1 21 established to determine damages in an eminent domain
1 22 proceeding is a governmental body and subject to the public
1 23 open meeting laws pursuant to Code chapter 21. The bill also
1 24 provides that the notice of the date and time of an appraisal
1 25 or assessment given by the sheriff to the compensation
1 26 commissioners shall be published by the sheriff to serve
1 27 public notice of the meeting of the commission.
