  1  1    Section 1.  Section 261.21, subsection 1, unnumbered
  1  2 paragraph 1, Code 1999, is amended to read as follows:
  1  3    Subject to an appropriation of sufficient funds by the
  1  4 general assembly, a member of the national guard who meets the
  1  5 eligibility requirements of this subsection is entitled shall
  1  6 receive tuition assistance to attend and pursue any
  1  7 undergraduate course of study at a community college as
  1  8 defined in chapter 260C, or an institution of higher learning
  1  9 under the control of the state board of regents upon the
  1 10 payment by the member personally of fifty percent of the
  1 11 tuition charged by the community college or institution of
  1 12 higher learning.  The remaining tuition shall be paid by the
  1 13 college student aid commission from funds appropriated by the
  1 14 general assembly.  To be eligible for tuition aid assistance
  1 15 under this section, a national guard member shall meet the
  1 16 following conditions:
  1 17    Sec. 2.  Section 261.21, subsection 2, Code 1999, is
  1 18 amended to read as follows:
  1 19    2.  Participation in the tuition aid program by an
  1 20 accredited private institution, as defined in section 261.9,
  1 21 is voluntary.  Subject to an appropriation of sufficient funds
  1 22 by the general assembly, a member of the Iowa national guard
  1 23 who meets the eligibility requirements of subsection 1, except
  1 24 for subsection 1, paragraph "d", is entitled shall receive
  1 25 tuition assistance to attend and pursue any undergraduate
  1 26 course of study at any participating accredited private
  1 27 institution, as defined in section 261.9, upon admission to
  1 28 the institution and payment of.  However, the amount of
  1 29 tuition less assistance shall not exceed an amount equal to
  1 30 fifty percent of the resident tuition rate established for
  1 31 institutions of higher learning under the control of the state
  1 32 board of regents.  The remaining tuition, not to exceed fifty
  1 33 percent of the resident tuition rate for a regents university,
  1 34 shall be paid by the college student aid commission from funds
  1 35 appropriated by the general assembly.  
  2  1                           EXPLANATION
  2  2    This bill, subject to an appropriation of sufficient funds
  2  3 by the general assembly, provides for full tuition assistance
  2  4 at community colleges and regents' universities for a member
  2  5 of the Iowa national guard who meets the eligibility
  2  6 requirements of the national guard tuition aid program.  Guard
  2  7 members, under the bill, can also receive tuition assistance
  2  8 to attend an accredited private postsecondary institution, but
  2  9 the tuition assistance cannot exceed the resident tuition rate
  2 10 established for institutions of higher learning under the
  2 11 control of the state board of regents.  Currently under the
  2 12 program, eligible guard members must contribute 50 percent of
  2 13 their tuition costs.
