PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. 1 2 BY McKEAN and LAMBERTI 1 3 (COMPANION TO LSB 7252HH BY THOMAS) 1 4 A Senate Concurrent Resolution requesting the office 1 5 of the attorney general to establish an operating 1 6 while intoxicated (OWI) task force to review the 1 7 clarity, complexity, and functionality of current 1 8 operating while intoxicated Code provisions and to 1 9 make recommendations to the general assembly. 1 10 WHEREAS, the provisions relating to operation of a 1 11 vehicle while a person is intoxicated in Code chapter 1 12 321J and related Code chapters have been amended over 1 13 the years in a manner which renders the provisions 1 14 difficult to monitor and understand; NOW THEREFORE, 1 15 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 1 16 REPRESENTATIVES CONCURRING, That the office of the 1 17 attorney general is requested to establish an 1 18 operating while intoxicated (OWI) task force to review 1 19 the clarity, complexity, and functionality of the OWI 1 20 provisions in Code chapter 321J and related Code 1 21 chapters, including the provisions relating to 1 22 administrative revocation of driver's licenses; and 1 23 BE IT FURTHER RESOLVED, That the members of the 1 24 task force should be appointed or determined and the 1 25 names of such members submitted to the office of the 1 26 attorney general by July 1, 2000; and 1 27 BE IT FURTHER RESOLVED, That the members of the 1 28 task force should include, but not be limited to, a 1 29 person appointed by the governor, the director of 1 30 transportation or the director's designee, the 2 1 commissioner of public safety or the commissioner's 2 2 designee, and representatives from the office of the 2 3 attorney general, the state public defender's office, 2 4 the Iowa state bar association, the Iowa county 2 5 attorneys association, and the Iowa police executive 2 6 forum; and 2 7 BE IT FURTHER RESOLVED, That the task force shall 2 8 submit a preliminary report recommending changes in 2 9 the scope, operation, or administration of the current 2 10 OWI provisions in Code chapter 321J and related Code 2 11 chapters to the general assembly and to the chairs and 2 12 ranking members of the house and senate standing 2 13 committees on judiciary by January 1, 2001, with the 2 14 primary purpose of the recommendations being the 2 15 clarification, simplification, and streamlining of the 2 16 current OWI provisions in Code chapter 321J and 2 17 related Code chapters, and may submit further 2 18 recommendations with the preliminary report if 2 19 necessary; and 2 20 BE IT FURTHER RESOLVED, That the task force shall 2 21 submit to the general assembly and to the chairs and 2 22 ranking members of the house and senate standing 2 23 committees on judiciary a final report on the findings 2 24 and recommendations of the task force relating to 2 25 proposed changes in the current OWI provisions in Code 2 26 chapter 321J and related Code chapters by January 1, 2 27 2002, if necessary; and 2 28 BE IT FURTHER RESOLVED, That this Concurrent 2 29 Resolution, being deemed of immediate importance, 2 30 takes effect upon enactment. 3 1 LSB 7252SS 78 3 2 nh/cls/14
