PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. ___ 1 2 BY DVORSKY, BLACK, BOLKCOM, CONNOLLY, 1 3 DELUHERY, FINK, FLYNN, FRAISE, HARPER, 1 4 KIBBIE, McCOY, SHEARER, GRONSTAL, and SZYMONIAK 1 5 A Concurrent Resolution relating to the state board of 1 6 regents five-year building program. 1 7 WHEREAS, pursuant to section 262A.3, the state 1 8 board of regents prepared and within seven days after 1 9 the convening of the Seventy-eighth General Assembly 1 10 of the State of Iowa, Second Session, submitted to the 1 11 Seventy-eighth General Assembly, Second Session, for 1 12 approval, the proposed five-year building program for 1 13 each institution of higher learning under the 1 14 jurisdiction of the board, containing a list of the 1 15 buildings and facilities which the board deems 1 16 necessary to further the educational objectives of the 1 17 institutions, together with an estimate of the cost of 1 18 each of the buildings and facilities and an estimate 1 19 of the maximum amount of revenue bonds which the board 1 20 expects to issue under chapter 262A for the fiscal 1 21 period beginning July 1, 2000, and ending June 30, 1 22 2002; and 1 23 WHEREAS, the projects contained in the capital 1 24 improvement program are deemed necessary for the 1 25 proper performance of the instructional, research, and 1 26 service functions of the institutions; and 1 27 WHEREAS, section 262A.4 provides that the state 1 28 board of regents, after authorization by a 1 29 constitutional majority of each house of the general 1 30 assembly and approval by the governor, may undertake 2 1 and carry out at the institutions of higher learning 2 2 under the jurisdiction of the board any project as 2 3 defined in chapter 262A; and 2 4 WHEREAS, chapter 262A authorizes the state board of 2 5 regents to borrow money and to issue and sell 2 6 negotiable revenue bonds to pay all or any part of the 2 7 costs of carrying out projects at any institution 2 8 payable solely from and secured by an irrevocable 2 9 pledge of a sufficient portion of the student fees and 2 10 charges and institutional income received by the 2 11 particular institution; and 2 12 WHEREAS, to further the educational objectives of 2 13 the institutions, the state board of regents requests 2 14 authorization to undertake and carry out certain 2 15 projects at this time and to finance the projects' 2 16 costs by borrowing money and issuing negotiable bonds 2 17 under chapter 262A in the total amount set forth in 2 18 this resolution, the remaining costs of the projects 2 19 to be financed by appropriations or by federal or 2 20 other funds lawfully available; NOW THEREFORE, 2 21 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 2 22 REPRESENTATIVES CONCURRING, That the proposed five- 2 23 year building program submitted by the state board of 2 24 regents for each institution of higher learning under 2 25 its jurisdiction is approved; and 2 26 BE IT FURTHER RESOLVED, That no commitment is 2 27 implied or intended by approval to fund any portion of 2 28 the proposed five-year building program submitted by 2 29 the state board of regents beyond the portion that is 2 30 financed and approved by the Seventy-eighth General 3 1 Assembly, Second Session, and the governor; and 3 2 BE IT FURTHER RESOLVED, That during the fiscal 3 3 period that commences July 1, 2000, and ends June 30, 3 4 2002, the maximum amount of bonds which the state 3 5 board of regents expects to issue under chapter 262A, 3 6 unless additional bonding is authorized, is as set 3 7 forth in this resolution, all or any part of which may 3 8 be issued during the fiscal year ending June 30, 2001, 3 9 and if all of that amount is not issued during that 3 10 fiscal year, any remaining balance may be issued 3 11 during the fiscal year ending June 30, 2002, and this 3 12 plan of financing is approved; and 3 13 BE IT FURTHER RESOLVED, That the state board of 3 14 regents is authorized to undertake, plan, construct, 3 15 equip, and otherwise carry out the following projects 3 16 at the institutions of higher learning under the 3 17 jurisdiction of the board, and the general assembly 3 18 authorizes the state board of regents to borrow money 3 19 and to issue and sell negotiable revenue bonds in the 3 20 manner provided in sections 262A.5 and 262A.6 in order 3 21 to pay all or any part of the costs of carrying out 3 22 the projects, at any institution, as follows: 3 23 Iowa State University of Science and Technology 3 24 Upgrade of systems in Gilman hall project costs: 3 25 ......................................... $ 11,000,000 3 26 Purchase of technology and equipment for the center 3 27 for excellence in fundamental plant science project 3 28 costs: 3 29 ......................................... $ 2,530,000 3 30 State University of Iowa 4 1 Renovation of biological sciences buildings project 4 2 costs: 4 3 ......................................... $ 14,700,000 4 4 University of Northern Iowa 4 5 McCollum science hall building addition project 4 6 costs: 4 7 ......................................... $ 16,900,000 4 8 Total $ 45,130,000 4 9 BE IT FURTHER RESOLVED, That if the amount of bonds 4 10 issued under this resolution exceeds the actual costs 4 11 of projects approved in this resolution, the amount of 4 12 the difference shall be used to pay the principal and 4 13 interest due on bonds issued under chapter 262A; and 4 14 BE IT FURTHER RESOLVED, That the state board of 4 15 regents may capitalize the issuance costs and bond 4 16 reserve fund equal to 11 percent of each bond issue 4 17 with respect to the bonds authorized pursuant to this 4 18 resolution and may increase the amount of the bonds 4 19 issued under this resolution to that extent. 4 20 LSB 5631XS 78 4 21 kh/cls/14.1
