  1  2    BY  KRAMER, IVERSON, REDWINE, BOETTGER, FREEMAN,
  1  3    SEXTON, GASKILL, BEHN, ZIEMAN, MILLER, VEENSTRA,
  1  4       HEDGE, LAMBERTI, REHBERG, MADDOX, REDFERN,
  1  5        ANGELO, JOHNSON, TINSMAN, RITTMER, RIFE,
  1  6     McKIBBEN, McLAREN, DRAKE, BARTZ, JENSEN, KING,
  1  7                  McKEAN, and SCHUERER
  1  8 A Concurrent Resolution urging congressional action to
  1  9    reject the plan by the United States Census Bureau to
  1 10    use statistical sampling in reporting population data
  1 11    to the states for purposes of redistricting.
  1 12    WHEREAS, the United States Constitution requires an
  1 13 actual enumeration of the population every 10 years,
  1 14 and entrusts Congress with overseeing all aspects of
  1 15 each decennial enumeration; and
  1 16    WHEREAS, the constitutional purpose of the
  1 17 decennial census is to apportion the seats in Congress
  1 18 among the several states; and
  1 19    WHEREAS, an accurate and legal decennial census is
  1 20 necessary to properly apportion United States House of
  1 21 Representatives seats among the 50 states and to
  1 22 create legislative districts within the states that
  1 23 comply with the constitutional requirement of one
  1 24 person, one vote; and
  1 25    WHEREAS, the United States Supreme Court has ruled
  1 26 that the Census Act expressly prohibits the use of
  1 27 statistical sampling to enumerate the United States
  1 28 population for the purpose of reapportioning the
  1 29 United States House of Representatives; and
  1 30    WHEREAS, despite the United States Supreme Court
  2  1 decision, the United States Census Bureau is still
  2  2 considering the use of statistical sampling in the
  2  3 reporting of population data to the states for use in
  2  4 legislative redistricting; and
  2  5    WHEREAS, the use of two methods for the
  2  6 determination and reporting of census data would
  2  7 create serious legal questions and uncertainties if
  2  8 adjusted population data is required to be used to
  2  9 determine legislative district boundaries;
  2 10    NOW THEREFORE, BE IT RESOLVED BY THE SENATE, THE
  2 11 HOUSE OF REPRESENTATIVES CONCURRING, That the General
  2 12 Assembly of the State of Iowa calls on the United
  2 13 States Census Bureau to conduct the 2000 decennial
  2 14 census consistent with the aforementioned United
  2 15 States Supreme Court ruling and constitutional
  2 16 mandate, which require a physical headcount of the
  2 17 population and bar the use of statistical sampling to
  2 18 create or in any way adjust the count; and
  2 19    BE IT FURTHER RESOLVED, That the General Assembly
  2 20 opposes the use and reporting of population data for
  2 21 state legislative redistricting based on census
  2 22 numbers that have been determined in whole or in part
  2 23 by the use of statistical inferences derived by means
  2 24 of random sampling techniques or other statistical
  2 25 methodologies that add or subtract persons to the
  2 26 census counts; and
  2 27    BE IT FURTHER RESOLVED, That the General Assembly
  2 28 demands that it receive population data for
  2 29 legislative redistricting identical to the census
  2 30 tabulation data used to apportion seats in the United
  3  1 States House of Representatives, consistent with the
  3  2 aforementioned United States Supreme Court ruling and
  3  3 constitutional mandate, which require a physical
  3  4 headcount of the population and bar the use of
  3  5 statistical sampling to create or in any way adjust
  3  6 the count; and
  3  7    BE IT FURTHER RESOLVED, That the General Assembly
  3  8 calls on the United States Census Bureau to ensure
  3  9 that the population data reported be as accurate as
  3 10 possible by providing a mechanism for citizens,
  3 11 consistent with applicable legal requirements, to
  3 12 challenge the population data reported as to a
  3 13 specific area and to seek a recount of the population
  3 14 in that area; and
  3 15    BE IT FURTHER RESOLVED, That the General Assembly
  3 16 urges Congress, as the branch of government assigned
  3 17 the responsibility of overseeing the decennial
  3 18 enumeration, to take whatever steps are necessary to
  3 19 ensure that the 2000 decennial census is conducted
  3 20 fairly and legally; and
  3 21    BE IT FURTHER RESOLVED, That a copy of this
  3 22 Resolution be transmitted to the President of the
  3 23 United States, the Vice President of the United
  3 24 States, the Speaker of the United States House of
  3 25 Representatives, the Majority Leader of the United
  3 26 States Senate, and members of Iowa's congressional
  3 27 delegation.
