  1  1    Amend Senate File 2433, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, line 26, by striking the figure
  1  4 "2,981,920" and inserting the following:  "3,181,920".
  1  5    #2.  Page 3, by inserting after line 13 the
  1  6 following:
  1  7    "6.  The department of economic development and the
  1  8 Iowa utilities board shall jointly develop a written
  1  9 report with recommendations to ensure that high-speed
  1 10 broadband internet access is available to rural areas
  1 11 of the state where such access is not currently
  1 12 available.  The written report shall be submitted to
  1 13 the legislative oversight committee of the legislative
  1 14 council by no later than October 1, 2000."
  1 15    #3.  Page 4, line 16, by striking the figure
  1 16 "3,563,943" and inserting the following:  "4,563,943".
  1 17    #4.  Page 4, by inserting after line 17 the
  1 18 following:
  1 19    "The division of information technology services
  1 20 shall not increase any fees or charges to other state
  1 21 agencies for services provided to such state agencies
  1 22 by the division, unless such increase in fees or
  1 23 charges is first submitted to, and approved by, the
  1 24 department of management.  It is the intent of the
  1 25 general assembly that the division not increase fees
  1 26 for the purpose of generating revenue to offset the
  1 27 difference in the amount of the appropriation
  1 28 contained in this section and the amount of the
  1 29 appropriation initially requested for the division by
  1 30 the department of general services."
  1 31    #5.  Page 5, line 8, by inserting after the figure
  1 32 "2001." the following:  "However, the amount to be
  1 33 deposited in the general fund pursuant to this
  1 34 unnumbered paragraph shall be reduced by an amount
  1 35 equal to the amount of revenue received by the state
  1 36 for deposit in the general fund of the state that
  1 37 exceeds the most recent estimate of the revenue
  1 38 estimating conference created in section 8.22A for the
  1 39 fiscal year beginning July 1, 1999, and ending June
  1 40 30, 2000.  The amount of the reduction in revenue to
  1 41 be deposited in the general fund as determined under
  1 42 this unnumbered paragraph shall be deposited in the
  1 43 pooled technology account."
  1 44    #6.  By striking page 5, line 13, through page 8,
  1 45 line 3, and inserting the following:
  1 46    "a.  The first $1,500,000 shall be allocated to the
  1 47 department of education for purposes of making
  1 48 technology available to students of accredited
  1 49 nonpublic schools in accordance with section 201 of
  1 50 this Act.
  2  1    b.  The next $1,000,000 shall be allocated to the
  2  2 university of northern Iowa for developing a twenty-
  2  3 first century learning initiative.  The university of
  2  4 northern Iowa shall consult with the division of
  2  5 information technology services of the department of
  2  6 general services and the department of education in
  2  7 developing this initiative.
  2  8    c.  The next $3,500,000 shall be allocated to the
  2  9 Iowa telecommunications and technology commission for
  2 10 continued buildout of asynchronous transfer mode
  2 11 technology for the network.
  2 12    d.  The next $200,000 shall be allocated to the
  2 13 department of management for developing budget system
  2 14 programs for township trustees.
  2 15    e.  The next $21,000,000 shall be allocated to the
  2 16 division of information technology services of the
  2 17 department of general services only for the projects
  2 18 designated in this paragraph as follows:
  2 19    (1)  A process project office for the division of
  2 20 information technology services of the department of
  2 21 general services.
  2 22    (2)  An electronic data collection, management, and
  2 23 reporting associated with the temporary assistance for
  2 24 needy families (TANF) welfare reform program of the
  2 25 department of human services.
  2 26    (3)  A child support recovery unit system for the
  2 27 department of human services.
  2 28    (4)  A corrections offender network for the
  2 29 department of corrections.
  2 30    (5)  The development of a resource house for the
  2 31 department of workforce development.
  2 32    (6)  A data warehouse for the division of criminal
  2 33 and juvenile justice planning of the department of
  2 34 human rights.
  2 35    (7)  Participation in the field automation and
  2 36 information management system (FAIM) by the department
  2 37 of agriculture and land stewardship.
  2 38    (8)  Gasoline measurement testing equipment for the
  2 39 department of agriculture and land stewardship.
  2 40    (9)  An electronic benefits transfer system for the
  2 41 department of human services.
  2 42    (10)  An electronic database directory of all
  2 43 health care and support services available to senior
  2 44 citizens for the department of elder affairs, as
  2 45 required under the senior living program Act, as
  2 46 enacted in Senate File 2193, and for other costs
  2 47 associated with the implementation of that program.
  2 48    (11)  The costs associated with filings under the
  2 49 Uniform Commercial Code if House File 2513 is enacted
  2 50 and incurred by the secretary of state.
  3  1    (12)  The conversion to digital television
  3  2 broadcasts by the public broadcasting division of the
  3  3 department of education.
  3  4    (13)  The continued buildout of asynchronous
  3  5 transfer mode technology for the Iowa communications
  3  6 network by the Iowa telecommunications and technology
  3  7 commission.
  3  8    (14)  An integrated institutional computer system
  3  9 for the veterans home of the department of veterans
  3 10 affairs.
  3 11    (15)  An electronic data warehouse for the
  3 12 department of human services.
  3 13    (16)  Establishment of an Iowa communications
  3 14 network room in the state historical building for the
  3 15 department of cultural affairs.
  3 16    (17)  An electronic data interchange for the
  3 17 department of education.
  3 18    (18)  The development and implementation of an
  3 19 electronic professional license renewal system for the
  3 20 division of information technology services of the
  3 21 department of general services.
  3 22    (19)  The development and implementation of an
  3 23 electronic system for vital records for the Iowa
  3 24 department of public health.
  3 25    (20)  The telefiling of tax returns for the
  3 26 department of revenue and finance.
  3 27    (21)  The development and implementation of an on-
  3 28 line system for issuing environmental permits for the
  3 29 department of natural resources.
  3 30    (22)  Reengineering projects for the division of
  3 31 information technology services of the department of
  3 32 general services.
  3 33    (23)  For budget system redesign to be completed by
  3 34 the department of management.
  3 35    (24)  The development and implementation of
  3 36 information technology security by the division of
  3 37 information technology services of the department of
  3 38 general services."
  3 39    #7.  By striking page 8, line 35, through page 9,
  3 40 line 1 and inserting the following:  "section 321A.3,
  3 41 subsection 1, shall be transferred to".
  3 42    #8.  Page 9, by striking lines 9 through 12.
  3 43    #9.  Page 9, by inserting after line 17 the
  3 44 following:
  3 45    "Sec. ___.  Section 14B.102, subsection 3, 2000
  3 46 Iowa Acts, Senate File 2395, if enacted, is amended by
  3 47 striking the subsection and inserting the following:
  3 48    3.  SERVICE CHARGES.  The department shall render a
  3 49 statement to a participating agency or other
  3 50 governmental entity for a reasonable and necessary
  4  1 amount for information technology provided by the
  4  2 department to such agency or entity.  An amount
  4  3 indicated on a statement rendered to a participating
  4  4 agency or other governmental entity shall be paid by
  4  5 such agency or entity in a manner determined by the
  4  6 department of revenue and finance.  Amounts charged
  4  7 and paid pursuant to this subsection shall be
  4  8 deposited in the operations revolving fund created in
  4  9 section 14B.102A."
  4 10    #10.  Page 12, by inserting after line 28 the
  4 11 following:
  4 12    "Sec. 101.  Section 455G.3, subsection 3, paragraph
  4 13 e, Code Supplement 1999, is amended by striking the
  4 14 paragraph.
  4 15    Sec. 102.  Section 455G.6, subsection 17, Code
  4 16 Supplement 1999, is amended by striking the
  4 17 subsection.
  4 18    Sec. 103.  Section 455G.9, subsection 1, Code
  4 19 Supplement 1999, is amended by adding the following
  4 20 new paragraph:
  4 21    NEW PARAGRAPH.  k.  Corrective action in response
  4 22 to a high risk condition caused by a release from an
  4 23 underground storage tank located on a site for which
  4 24 the department, after January 31, 1997, has issued a
  4 25 no further action certificate under section 455B.474.
  4 26 As a condition of receiving benefits under this
  4 27 paragraph, the department must determine that the
  4 28 condition necessitating the corrective action was not
  4 29 a result of a release that occurred after the issuance
  4 30 of the no further action certificate, and that the
  4 31 site qualified for remedial benefits under this
  4 32 section prior to the issuance of the no further action
  4 33 certificate.  No more than one hundred thousand
  4 34 dollars per site may be used for the costs of a
  4 35 corrective action under this paragraph.  This
  4 36 paragraph does not confer a legal right on an owner or
  4 37 operator of petroleum-contaminated property or on any
  4 38 other person to receive benefits under this
  4 39 paragraph."
  4 40    #11.  Page 16, by inserting after line 9, the
  4 41 following:
  4 42    "Sec. 104.  Section 455G.22, Code 1999, is
  4 43 repealed.
  4 44    Sec. 105.  Notwithstanding section 455G.22,
  4 45 unencumbered and unobligated moneys remaining in the
  4 46 no further action fund on the effective date of this
  4 47 section shall be transferred to the pooled technology
  4 48 account established in section 5 of this Act."
  4 49    #12.  Page 16, by inserting after line 9 the
  4 50 following:
  5  1    "Sec.    .  Section 14B.102, subsection 2,
  5  2 paragraph d, as enacted by 2000 Iowa Acts, Senate File
  5  3 2395, is amended to read as follows:
  5  4    d.  Developing and implementing recommended
  5  5 Implementing standards for information technology,
  5  6 including but not limited to system design and systems
  5  7 integration and interoperability, as developed by the
  5  8 council pursuant to section 14B.107, which when
  5  9 implemented shall apply to all participating agencies
  5 10 except as otherwise provided in this chapter.  The
  5 11 department shall implement information technology
  5 12 standards as established pursuant to this chapter
  5 13 which are applicable to information technology
  5 14 procurements for participating agencies and to
  5 15 information technology development by participating
  5 16 agencies.
  5 17    Sec.    .  Section 14B.104, subsection 2, paragraph
  5 18 b, as enacted by 2000 Iowa Acts, Senate File 2395, is
  5 19 amended to read as follows:
  5 20    b.  Develop recommended standards for consideration
  5 21 with respect to the procurement and development of
  5 22 information technology by all participating agencies
  5 23 as provided in section 14B.107.
  5 24    Sec.    .  Section 14B.107, as enacted by 2000 Iowa
  5 25 Acts, Senate File 2395, is amended to read as follows:
  5 26    14B.107  INFORMATION TECHNOLOGY STANDARDS.
  5 27    The information technology council shall develop
  5 28 recommended standards for consideration with respect
  5 29 to the procurement and development of information
  5 30 technology by all participating agencies.  It is the
  5 31 intent of the general assembly that information
  5 32 technology standards be established for the purpose of
  5 33 guiding such procurements and development.  Such
  5 34 standards, unless waived by the council, shall apply
  5 35 to all information technology procurements for
  5 36 participating agencies and to all information
  5 37 technology development by participating agencies.
  5 38    Standards adopted pursuant to this section shall
  5 39 apply to existing information technology in use by
  5 40 participating agencies on the effective date of this
  5 41 Act.  A participating agency, by no later than June
  5 42 30, 2002, shall seek to procure or develop information
  5 43 technology to replace existing information technology
  5 44 which does not meet the standards adopted by the
  5 45 council, unless a waiver is procured with respect to
  5 46 such information technology pursuant to section
  5 47 14B.104.
  5 48    The office of the governor or the office of an
  5 49 elective constitutional or statutory officer shall
  5 50 consult with the department prior to procuring or
  6  1 developing information technology and consider the
  6  2 standards recommended by the council, and provide a
  6  3 written report to the department relating to the
  6  4 office's decision regarding such acquisitions
  6  5 procurements or development.
  6  6    Sec.    .  Section 14B.108, subsection 2, paragraph
  6  7 a, as enacted by 2000 Iowa Acts, Senate File 2395, is
  6  8 amended to read as follows:
  6  9    a.  Standards established by the council, unless
  6 10 waived pursuant to section 14B.104, shall apply to all
  6 11 information technology procurements for participating
  6 12 agencies and to all information technology development
  6 13 by participating agencies.
  6 14    Sec. 201.  TECHNOLOGY SERVICES FOR ACCREDITED
  6 15 NONPUBLIC SCHOOL STUDENTS.
  6 16    1.  Technology adopted and purchased by a school
  6 17 district shall, to the extent funds are appropriated
  6 18 by the general assembly, be made available to students
  6 19 of accredited nonpublic schools located within the
  6 20 boundaries of the school district upon the written
  6 21 request of the authorities in charge of the accredited
  6 22 nonpublic school on behalf of the school's students as
  6 23 provided in this section.
  6 24    2.  Funds appropriated for purposes of this section
  6 25 shall be allocated to school districts for the
  6 26 purchase of technology for accredited nonpublic
  6 27 schools as provided in this section, subject to the
  6 28 restrictions of section 295.4, subsection 1.  The
  6 29 department of education shall ascertain a maximum
  6 30 annual amount the school district shall be required to
  6 31 use for the purchase of technology for participating
  6 32 accredited nonpublic schools.  The amount shall be in
  6 33 the proportion that the basic enrollment of a
  6 34 participating accredited nonpublic school bears to the
  6 35 sum of the basic enrollments of all participating
  6 36 accredited nonpublic schools in the state for the
  6 37 budget year.  A participating accredited nonpublic
  6 38 school shall certify its actual enrollment to the
  6 39 department of education by October 1, 2000.  By
  6 40 October 15, 2000, the department of education shall
  6 41 notify the board of directors of each school district
  6 42 of the maximum amount of its allocation that shall be
  6 43 made available for purchasing nonsectarian,
  6 44 nonreligious technology for each of the participating
  6 45 accredited nonpublic schools located within the school
  6 46 district in accordance with this section.  For
  6 47 purposes of this section only, an accredited nonpublic
  6 48 school's enrollment count shall include only students
  6 49 who are residents of Iowa.
  6 50    3.  The costs of providing technology to
  7  1 participating accredited nonpublic schools as provided
  7  2 in this section shall not be included in the
  7  3 computation of district cost under chapter 257, but
  7  4 shall be shown in the budget as an expense from
  7  5 miscellaneous income.  Technology expenditures made in
  7  6 accordance with this section shall be kept on file in
  7  7 the school district."
  7  8    #13.  Page 16, by inserting after line 28 the
  7  9 following:
  7 10    "Sec.    .  DEPARTMENT OF MANAGEMENT
  7 11 RECOMMENDATIONS.  The department of management shall
  7 12 develop written recommendations to be delivered to the
  7 13 general assembly by no later than the start of the
  7 14 2001 regular legislative session with respect to both
  7 15 of the following:
  7 16    1.  Resolution of the overbilling of the federal
  7 17 government for certain services provided by the state
  7 18 to the federal government, and as a result of which
  7 19 the federal government is seeking reimbursement.
  7 20    2.  The manner in which the state's three data
  7 21 centers should be managed."
  7 22    #14.  Page 16, line 29, by inserting after the
  7 23 figure "5," the following:  "101, 102, 103,".
  7 24    #15.  Page 16, line 30, by striking the word and
  7 25 figure "and 17" and inserting the following:  "17,
