1 1 Amend the amendment, S-5622, to House File 2549, as
1 2 amended, passed, and reprinted by the House, as
1 3 follows:
1 4 #1. Page 30, by inserting after line 13 the
1 5 following:
1 6 "Sec. ___. Section 282.18, Code 1999, is amended
1 7 by adding the following new subsection:
1 8 NEW SUBSECTION. 19. A parent or guardian who
1 9 desires to enroll the parent or guardian's child in a
1 10 prekindergarten program offered by a district other
1 11 than the district of residence may petition the other
1 12 district by January 1 of the previous school year for
1 13 permission to enroll the child in the receiving
1 14 district for a period of not less than one year. Upon
1 15 receipt of such a request, the receiving district
1 16 board may act on the enrollment request at the next
1 17 regularly scheduled board meeting after the receipt of
1 18 the request. The receiving district shall enroll the
1 19 child in a prekindergarten program offered by the
1 20 district unless there is insufficient classroom space
1 21 in the district. A denial of a request to change
1 22 district enrollment within the approved period is
1 23 subject to appeal under section 290.1. However, a
1 24 child who has been in attendance in another district
1 25 under this section may return to the district of
1 26 residence and enroll at any time, once the parent or
1 27 guardian has notified the district of residence and
1 28 the receiving district in writing of the decision to
1 29 enroll the child in the district of residence. The
1 30 provisions of subsections 2, 3, 7, 9, and 10 shall not
1 31 apply with regard to a child who participates in open
1 32 enrollment in accordance with this subsection."
