  1  1    Amend House File 2545, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 5, by inserting after line 5 the
  1  4 following:
  1  5    "   .  UTILITIES DIVISION
  1  6    For the establishment of a registry of individuals
  1  7 who do not want to receive telephone solicitations
  1  8 pursuant to section 476B.1:  
  1  9 .................................................. $     50,000"
  1 10    2.  Page 33, by inserting after line 19 the
  1 11 following:
  1 12    "Sec.    .  NEW SECTION.  476B.1  TELEPHONE
  1 13 SOLICITATION REGISTRY – PROHIBITED ACT.
  1 14    1.  The utilities board shall establish and
  1 15 maintain a telephone solicitation registry including a
  1 16 list of telephone numbers of residential telephone
  1 17 subscribers who object to receiving telephone
  1 18 solicitations.  The board shall establish the registry
  1 19 by no later than January 1, 2001.
  1 20    2.  A person shall not make or cause to be made a
  1 21 telephone solicitation to a residential telephone
  1 22 subscriber in this state who has requested that the
  1 23 board include such subscriber's number on the
  1 24 telephone solicitation registry.
  1 25    3.  A person who makes or causes to be made a
  1 26 telephone solicitation in violation of subsection 2 is
  1 27 subject to the following:
  1 28    a.  A civil penalty of five hundred dollars for a
  1 29 first violation.
  1 30    b.  A civil penalty of one thousand dollars for
  1 31 each subsequent violation.
  1 32    4.  Civil penalties imposed and collected as
  1 33 provided in subsection 3 shall be distributed as
  1 34 follows:
  1 35    a.  Fifty percent of the civil penalty shall be
  1 36 remitted to the residential telephone subscriber who
  1 37 received the telephone solicitation in violation of
  1 38 subsection 2.
  1 39    b.  Fifty percent of the civil penalty shall be
  1 40 deposited in the general fund of the state.
  1 41    5.  The board shall adopt rules necessary to
  1 42 administer this section."
