  1  1    Amend Senate File 2447 as follows:
  1  2    #1.  Page 1, line 17, by inserting after the word
  1  3 "board." the following:  "In performing its functions
  1  4 the board is performing a public function on behalf of
  1  5 the state and is a public instrumentality of the
  1  6 state."
  1  7    #2.  Page 2, line 29, by inserting before the word
  1  8 "DUTIES" the following:  "BOARD".
  1  9    #3.  By striking page 2, line 32, through page 3,
  1 10 line 1, and inserting the following:
  1 11    "2.  Establish the vision Iowa program and the
  1 12 community attraction and tourism program.
  1 13    3.  Oversee and provide approval of the
  1 14 administration of the vision Iowa program and the
  1 15 community attraction and tourism program by the
  1 16 department.
  1 17    4.  Request the treasurer of state to issue bonds
  1 18 on behalf of the board for purposes of the vision Iowa
  1 19 program."
  1 20    #4.  Page 3, by inserting before line 2 the

  1 22    "Sec.    .  NEW SECTION.  15F.103A  DEPARTMENT
  1 23 DUTIES.
  1 24    The department, subject to approval by the board,
  1 25 shall adopt administrative rules pursuant to chapter
  1 26 17A necessary to administer the community attraction
  1 27 and tourism program and the vision Iowa program.  The
  1 28 department shall provide the board with assistance in
  1 29 implementing administrative functions, marketing the
  1 30 programs, providing technical assistance and
  1 31 application assistance to applicants under the
  1 32 programs, negotiating contracts, and providing project
  1 33 follow-up.  The department, in cooperation with the
  1 34 treasurer of state, may conduct negotiations on behalf
  1 35 of the board with applicants regarding terms and
  1 36 conditions applicable to awards under the programs."
  1 37    #5.  Page 3, line 20, by inserting after the word
  1 38 "and" the following:  "the department, subject to
  1 39 direction and approval by the board, shall".

  1 41 "project" the following:  ", including but not limited

  2  6 infrastructure project with demonstrated substantial
  2  7 regional or statewide economic impact.  For purposes
  2  8 of the program, "vertical infrastructure" means land
  2  9 acquisition and construction, major renovation and
  2 10 major repair of buildings, all appurtenant structures,
  2 11 utilities, site development, and recreational trails.
  2 12 "Vertical infrastructure" does not include routine,
  2 13 recurring maintenance or operational expenses or
  2 14 leasing of a building, appurtenant structure, or
  2 15 utility without a lease-purchase agreement."
  2 16    #11.  Page 5, line 16, by inserting after the word
  2 17 "award." the following:  "The treasurer of state shall
  2 18 notify the department anytime moneys are disbursed to
  2 19 a recipient of financial assistance under the
  2 20 program."
  2 21    #12.  Page 7, line 1, by inserting after the word
  2 22 "and" the following:  "the department, subject to
  2 23 direction and approval by the board, shall".

  2 27    "2.  An applicant must demonstrate financial and
  2 28 nonfinancial support for the project which may be from
  2 29 a public or private source.  Nonfinancial support may
  2 30 include, but is not limited to, the the value of labor
  2 31 and services, real and personal property donated for
  2 32 purposes of the project, and the use of real and
  2 33 personal property for purposes of the project.  The
  2 34 financial and nonfinancial support for the project
  2 35 described under this subsection shall equal at least
  2 36 fifty percent of the total cost of the project."

  2 38 paragraph" and inserting the following:  "the
  2 39 program".

  3 50 be used only for the purposes of the vision Iowa fund.
  4  1 The treasurer of state shall act as custodian of the
  4  2 fund and disburse moneys contained in the fund as
  4  3 directed by the board, including automatic
  4  4 disbursements of funds received pursuant to the terms
  4  5 of bond indentures and documents and security
  4  6 provisions to trustees.  The fund shall be
  4  7 administered by the board which shall make
  4  8 expenditures from the fund consistent with the
  4  9 purposes of the vision Iowa program without further
  4 10 appropriation.  An applicant under the vision".
  4 11    #33.  Page 14, line 3, by striking the words "its
  4 12 bonds or notes" and inserting the following:  "bonds
  4 13 or notes issued pursuant to section 12.71".

  4 31 charge against the general credit or general fund of
  4 32 the state.  The issuance of any bonds or notes
  4 33 pursuant to section 12.71 by the treasurer of state
  4 34 does not directly, indirectly, or contingently
  4 35 obligate the state or a political subdivision of the
  4 36 state to apply moneys from, or to levy or pledge any
  4 37 form of taxation whatever, to the payment of the bonds
  4 38 or notes.  Bonds and notes issued under section 12.71
  4 39 are payable solely and only from the sources and
  4 40 special fund provided in section 12.72."

  4 45    "Sec.    .  Section 384.95, subsection 1, Code
  4 46 1999, is amended to read as follows:
  4 47    1.  "Public improvement" means any building or
  4 48 construction work, either within or outside the
  4 49 corporate limits of a city, to be paid for in whole or
  4 50 in part by the use of funds of the city, regardless of
  5  1 sources, including a building or improvement
  5  2 constructed or operated jointly with any other public
  5  3 or private agency, but excluding urban renewal
  5  4 demolition and low-rent housing projects, industrial
  5  5 aid projects authorized under chapter 419, emergency
  5  6 work or work performed by employees of a city or a
  5  7 city utility."
  5  8    #42.  Page 23, line 10, by inserting after the word
  5  9 "years." the following:  "The repeal and reenactment
  5 10 of Code sections relating to the community attraction
  5 11 and tourism development program and the community
  5 12 attraction and tourism development fund shall not
  5 13 nullify any awards made under the program based on

  5 15 section 3, subsection 2, for the fiscal years
  5 16 beginning July 1, 1999, and July 1, 2000."
