PAG LIN 1 1 Amend Senate File 2448 as follows: 1 2 #1. By striking page 6, line 34, through page 8, 1 3 line 23, and inserting the following: 1 4 "Sec. . NEW SECTION. 214A.16A RENEWABLE 1 5 REFORMULATED GASOLINE AVAILABILITY REQUIRED. 1 6 1. Except as provided in this section, a retail 1 7 dealer shall not sell conventional gasoline at a site, 1 8 unless the retail dealer also sells renewable 1 9 reformulated gasoline at that site. A retail dealer 1 10 required to sell renewable reformulated gasoline must 1 11 operate at least one motor vehicle fuel pump that 1 12 dispenses renewable reformulated gasoline at the same 1 13 site where the retail dealer operates a motor vehicle 1 14 fuel pump that dispenses conventional gasoline. 1 15 2. a. This section does not apply to the extent 1 16 that a retail dealer cannot sell renewable 1 17 reformulated gasoline at a site because the motor 1 18 vehicle fuel storage tank equipment located on the 1 19 site is not compatible with storing and dispensing 1 20 renewable reformulated gasoline. 1 21 b. This section does not require a retail dealer 1 22 to sell renewable reformulated gasoline at a site if 1 23 the site has only one single undivided motor vehicle 1 24 fuel storage tank. 1 25 c. This section does not require a retail dealer 1 26 to cease selling conventional gasoline during any 1 27 period when the retail dealer cannot sell renewable 1 28 reformulated gasoline due to any of the following: 1 29 (1) A wholesale dealer fails to supply the retail 1 30 dealer with renewable reformulated gasoline on a 1 31 timely basis. This subparagraph does not apply if the 1 32 retail dealer and the wholesale dealer are the same 1 33 person. 1 34 (2) A temporary depletion of the retail dealer's 1 35 renewable reformulated gasoline inventory. This 1 36 subparagraph does not apply if the retail dealer 1 37 stores renewable reformulated gasoline in the depleted 1 38 tank. 1 39 (3) A communication, including the issuance of an 1 40 order or letter, by a federal or state agency, 1 41 including the United States environmental protection 1 42 agency, the department of natural resources, or the 1 43 department of agriculture and land stewardship, 1 44 requiring or requesting that the retail dealer cease 1 45 using a motor vehicle fuel storage tank storing 1 46 renewable reformulated gasoline or related motor 1 47 vehicle fuel storage tank equipment. This 1 48 subparagraph does not apply once the terms of the 1 49 communication have expired. 1 50 (4) A motor vehicle fuel storage tank used to 2 1 store renewable reformulated gasoline or related motor 2 2 vehicle fuel storage tank equipment cannot function 2 3 because of repair, replacement, or maintenance. This 2 4 subparagraph does not apply after the tank or related 2 5 equipment has been repaired, replaced, or maintained 2 6 or should have been repaired, replaced, or maintained 2 7 within a period customary for that type of repair, 2 8 replacement, or maintenance. 2 9 3. The department shall adopt pursuant to chapter 2 10 17A all rules necessary in order to administer this 2 11 section." 2 12 #2.
