  2  5       .  Of the funds appropriated in this section,
  2  6 $100,000 is allocated for development of a plan for
  2  7 implementation of a personal assistance services
  2  8 program as described in House File 2380, as introduced
  2  9 in the Seventy-eighth General Assembly, 2000 Session.
  2 10 The target date used in the plan for implementation of
  2 11 the program shall be July 1, 2002.
  2 12    The department, in consultation with the department
  2 13 of elder affairs, the Iowa department of public
  2 14 health, the department of workforce development, the
  2 15 department of education, division of vocational
  2 16 rehabilitation, the department of economic
  2 17 development, the Iowa state association of counties,
  2 18 Iowa creative employment options, the community
  2 19 services affiliate of the Iowa state association of
  2 20 counties, and the personal assistance and family
  2 21 support services council, shall convene a planning
  2 22 committee, which includes consumers and family
  2 23 members, advocates of consumers, providers of services
  2 24 to consumers, and the entities consulted with, to
  2 25 assist in the development of a plan for a personal
  2 26 assistance services program based on principles and
  2 27 standards described in this chapter.  The membership
  2 28 of the planning committee shall be appointed in a
  2 29 manner so there are relatively equal proportions of
  2 30 members with involvement in service management,
  2 31 purchasing or approval, and members with an interest
  2 32 in or involvement as a service consumer or advocate.
  2 33 The planning committee shall also include four members
  2 34 of the general assembly to serve in an ex officio,
  2 35 nonvoting capacity with one each appointed by the
  2 36 following:  senate majority leader, senate minority
  2 37 leader, speaker of the house of representatives, and
  2 38 minority leader of the house of representatives.  The
  2 39 department may contract for services to support the
  2 40 planning committee.  At a minimum, the plan shall
  2 41 include options to accomplish all of the following:
  2 42    a.  Designate a lead agency to be responsible for
  2 43 administering the personal assistance services
  2 44 program.
  2 45    b.  Provide that the personal assistance and family
  2 46 support services policy council assist in the design,
  2 47 implementation, marketing, and evaluation of the
  2 48 state's personal assistance services program.
  2 49    c.  Provide a consumer-level administrative
  2 50 oversight and technical assistance mechanism relating
  3  1 to the planning, administrative rules development, and
  3  2 implementation of the personal assistance services
  3  3 program.
  3  4    d.  Provide for a transition process, with action
  3  5 steps and time lines, describing how the state will
  3  6 make personal assistance services a viable option that
  3  7 is more cost-effective and responsive to the needs and
  3  8 preferences of consumers.
  3  9    e.  Describe a process for consolidating all
  3 10 noninstitutional personal assistance services programs
  3 11 funded through the medical assistance program.
  3 12    f.  Describe the type of personal assistance
  3 13 services to be provided under the program.
  3 14    g.  Describe the method of delivery of personal
  3 15 assistance services and how such services will be
  3 16 delivered statewide.
  3 17    h.  Evaluate the feasibility of further reducing
  3 18 costs and addressing consumer needs and preferences
  3 19 through the provision of auxiliary services such as
  3 20 assistive technology and home modifications.
  3 21    i.  Describe a program intake process that will be
  3 22 uniform throughout the state.
  3 23    j.  Review and consolidate the eligibility
  3 24 requirements, intake processes, assessment tools, and
  3 25 other relevant processes of all existing personal
  3 26 assistance services waiver and pilot programs into a
  3 27 single, comprehensive system.
  3 28    k.  Describe the standards and mechanisms for
  3 29 copayments or cost-sharing and the methods used to
  3 30 determine income eligibility of persons with
  3 31 disabilities.
  3 32    l.  Determine quality assurance outcomes and
  3 33 safeguards against physical, emotional, or financial
  3 34 abuse and exploitation.
  3 35    m.  Describe the appeal process.
  3 36    n.  Describe how the barriers and disincentives
  3 37 that currently discourage people from becoming
  3 38 personal assistants can be removed.
  3 39    o.  Address the issues of provider and consumer
  3 40 liability.
  3 41    p.  Describe acceptable methods whereby independent
  3 42 personal assistance services providers may pool
  3 43 resources to ensure adequate coverage provisions for
  3 44 health insurance, liability insurance, and workers'
  3 45 compensation insurance.
  3 46    q.  Consult with the health care financing
  3 47 administration of the United States department of
  3 48 health and human services, in reviewing and completing
  3 49 a plan for consolidation and coordination of funding
  3 50 mechanisms and expenditures relative to health care
  4  1 facility services, intermediate care facilities for
  4  2 persons with mental retardation services, all covered
  4  3 home and community-based services provided under
  4  4 section 1915(c) of the federal Social Security Act,
  4  5 services provided under the personal care option of
  4  6 the medical assistance program, and frail elderly
  4  7 program services.  The plan shall provide for
  4  8 consolidation and coordination of funding mechanisms
  4  9 and expenditures in order to provide funding for the
  4 10 personal assistance services described in this
  4 11 subsection and shall address the costs and potential
  4 12 cost offsets in implementing the personal care option
  4 13 under the medical assistance program.
  4 14    r.  Develop options to capitalize on and leverage
  4 15 federal funding to the maximum extent possible under
  4 16 the federal Ticket to Work and Work Incentives
  4 17 Improvement Act of 1999, Pub. L. No. 106-170 and the
  4 18 federal Workforce Investment Act of 1998, Pub. L. No.
  4 19 105-220.
  4 20    Sec.    .  PHARMACEUTICAL CASE MANAGEMENT STUDY.
  4 21 There is appropriated from the general fund of the
  4 22 state to the department of human services for the
  4 23 fiscal year beginning July 1, 2000, and ending June
  4 24 30, 2001, the following amount or so much thereof as
  4 25 is necessary, to be used for implementation of a
  4 26 disease-specific pharmaceutical case management study
  4 27 to measure the effects of case management for medical
  4 28 assistance recipients identified by the department as
  4 29 high risk for medication-related problems.  The funds
  4 30 shall be used to equally reimburse physician-
  4 31 pharmacist teams who participate in the study.  An
  4 32 advisory committee whose membership consists of
  4 33 representatives of the Iowa medical society, the Iowa
  4 34 pharmacy association, and the department of human
  4 35 services shall establish and implement the
  4 36 pharmaceutical case management study.  The university
  4 37 of Iowa college of public health, in conjunction with
  4 38 the colleges of medicine and pharmacy, shall perform
  4 39 an evaluation of the study at no cost to the state and
  4 40 shall submit a final report of the findings of the
  4 41 evaluation and any recommendations to the general
  4 42 assembly by December 15, 2002.  The department shall
  4 43 submit a progress report by December 15, 2001, and a
  4 44 final report by December 15, 2002, to the general
  4 45 assembly.  The department shall adopt rules to
  4 46 implement this section which comply with the notice of
  4 47 intended action requirements of section 17A.4,
  4 48 subsection 1, and which may be adopted as emergency
  4 49 rules pursuant to section 17A.5, subsection 2, after
  4 50 notice is provided.  The rules shall be reevaluated by
  5  1 the department of human services with input from the
  5  2 Iowa medical society and the Iowa pharmacy
  5  3 association, upon submission of the final report or by
  5  4 December 15, 2002, whichever occurs first:  
  5  5 .................................................. $    414,000"

  7 38 or brain injury, shall be the facility's actual cost,
  7 39 as determined from the annual actual cost reports
  7 40 submitted to the department.  The cost reports shall
  7 41 be subject to annual audit by the department.
  7 42 Responsibility for payment of the nonfederal share of
  7 43 reimbursement paid for services provided to eligible
  7 44 persons shall be as follows:  the county of legal
  7 45 settlement is responsible for an amount equal to the
  7 46 nonfederal share of the 80th percentile of ICFMR
  7 47 services and the state is responsible for the
  7 48 remainder."
