Page 74, by striking lines 21 and 22, and 1 7 inserting the following: 1 8 "10. AGRICULTURAL LIENS PREVAIL. The provisions 1 9 of this Article regarding agricultural liens prevail 1 10 over any inconsistent provisions of subsection 9." 1 11 #3. Page 173, by inserting after line 28, the 1 12 following: 1 13 "Sec. . Section 570.1, Code 1999, is amended to 1 14 read as follows: 1 15 570.1 LIEN CREATED PROPERTY SUBJECTED. 1 16 1. A landlord shall have a lien for the rent upon 1 17 all crops grown upon the leased premises, and upon any 1 18 other personal property of the tenant which has been 1 19 used or kept thereon during the term and which is not 1 20 exempt from execution. 1 21 2. In order to perfect a lien in farm products as 1 22 defined in section 554.9102, which is created under 1 23 this section, a landlord must file a financing 1 24 statement as required by section 554.9308, subsection 1 25 2. Except as provided in chapters 571, 572, 579A, 1 26 579B, and 581, a perfected lien in the farm products 1 27 has priority over a conflicting security interest or 1 28 lien, including a security interest or lien that was 1 29 perfected prior to the creation of the lien under this 1 30 section, if the lien created in this section is 1 31 perfected on either of the following dates: 1 32 a. Prior to July 1, 2001. 1 33 b. When the debtor takes possession of the leased 1 34 premises or within twenty days after the debtor takes 1 35 possession of the leased premises. 1 36 A financing statement filed to perfect a lien in 1 37 the farm products must include a statement that it is 1 38 filed for the purpose of perfecting a landlord's lien. 1 39 Within twenty days after a landlord who has filed a 1 40 financing statement receives a written demand, 1 41 authenticated as provided in Article 9 of chapter 554, 1 42 from a tenant, the landlord shall file a termination 1 43 statement, if the lien in the farm products has 1 44 expired or if the tenant is no longer in possession of 1 45 the leased premises and has performed all obligations 1 46 under the lease." 1 47 #4.
