1 3 #1. Page 5, by inserting after line 12, the
1 4 following:
1 5 "Sec. . GUNS – INFORMED CONSENT TO PURCHASE.
1 6 1. For the purposes of this section, "secure gun
1 7 safety device" means any of the following:
1 8 a. A device that, when installed on a pistol or
1 9 revolver, is designed to prevent the pistol or
1 10 revolver from being operated without first
1 11 deactivating or removing the device.
1 12 b. A device incorporated into the design of the
1 13 pistol or revolver that is designed to prevent the
1 14 operation of the pistol or revolver by anyone not
1 15 having access to the device.
1 16 2. A person that engages in the retail sale of
1 17 pistols or revolvers, other than antique firearms,
1 18 shall not sell any pistol or revolver, without first
1 19 obtaining written informed consent from the consumer
1 20 to purchase the pistol or revolver including by
1 21 providing all of the following information to the
1 22 consumer at least twenty-four hours prior to the
1 23 actual sale of the pistol or firearm:
1 24 a. Information regarding the person's options
1 25 regarding gun safety, including but not limited to
1 26 secure gun safety devices, safe storage of weapons,
1 27 and weapons training programs.
1 28 b. Information regarding the number of fatalities
1 29 and injuries resulting from the lack of utilization of
1 30 gun safety measures. Such information shall include
1 31 materials, including pictures and drawings, which
1 32 provide realistic and appropriate depictions of the
1 33 results of the lack of utilization of gun safety
1 34 measures, and shall be objective, nonjudgmental, and
1 35 designed to convey only accurate scientific
1 36 information about the results of the lack of
1 37 utilization of gun safety measures.
1 38 c. Geographically indexed materials designed to
1 39 inform the consumer of services available to assist
1 40 the consumer in gun safety measures, categorized by
1 41 type of services offered, and a description of the
1 42 manner, including telephone numbers, in which the
1 43 services may be accessed.
1 44 3. The retailer shall obtain written certification
1 45 from the consumer that the information required
1 46 pursuant to subsection 2 was provided and that the
1 47 consumer has consented to the purchase of the pistol
1 48 or revolver.
1 49 4. A person who knowingly or recklessly violates
1 50 the informed consent provisions of this section is
2 1 guilty of a simple misdemeanor."
