  1  5    #2.  Page 59, by inserting after line 34 the
  1  6 following:
  1  7    "Sec.    .  Section 249A.3, subsection 1, Code
  1  8 Supplement 1999, is amended by adding the following
  1  9 new paragraph after paragraph k:
  1 10    NEW PARAGRAPH.  kk.  Is an infant whose income is
  1 11 not more than two hundred percent of the federal
  1 12 poverty level, as defined by the most recently revised
  1 13 income guidelines published by the United States
  1 14 department of health and human services.
  1 15    Sec.    .  Section 514I.8, subsection 1, Code 1999,
  1 16 is amended to read as follows:
  1 17    1.  Effective July 1, 1998, and notwithstanding any
  1 18 medical assistance program eligibility criteria to the
  1 19 contrary, medical assistance shall be provided to, or
  1 20 on behalf of, an eligible child under the age of
  1 21 nineteen whose family income does not exceed one
  1 22 hundred thirty-three percent of the federal poverty
  1 23 level, as defined by the most recently revised poverty
  1 24 income guidelines published by the United States
  1 25 department of health and human services.
  1 26 Additionally, effective July 1, 2000, and
  1 27 notwithstanding any medical assistance program
  1 28 eligibility criteria to the contrary, medical
  1 29 assistance shall be provided to, or on behalf of, an
  1 30 eligible infant whose family income does not exceed
  1 31 two hundred percent of the federal poverty level, as
  1 32 defined by the most recently revised poverty income
  1 33 guidelines published by the United States department
  1 34 of health and human services.
  1 35    Sec.    .  Section 514I.8, subsection 2, paragraph
  1 36 c, Code 1999, is amended to read as follows:
  1 37    c.  Is a member of a family whose adjusted gross
  1 38 income does not exceed one two hundred eighty-five
  1 39 percent of the federal poverty level, as defined in 42
  1 40 U.S.C. } 9902(2), including any revision required by
  1 41 such section.
  1 42    Sec.    .  Section 514I.10, Code 1999, is amended
  1 43 to read as follows:
  1 44    514I.10  COST SHARING.
  1 45    1.  Cost sharing for eligible children whose family
  1 46 adjusted gross income is at or below one hundred fifty
  1 47 percent of the federal poverty level shall not exceed
  1 48 the standards permitted under 42 U.S.C. }
  1 49 1396(o)(a)(3) or } 1396(o)(b)(1).
  1 50    2.  Cost sharing for eligible children whose family
  2  1 adjusted gross income is between one hundred fifty
  2  2 percent and one two hundred eighty-five percent of the
  2  3 federal poverty level shall include a premium or
  2  4 copayment amount which is at least a minimum amount
  2  5 but which does not exceed five percent of the annual
  2  6 family adjusted gross income.  The amount of the
  2  7 premium or the copayment amount shall be based on a
  2  8 sliding fee scale established by rule which is based
  2  9 on family adjusted gross income and the size of the
  2 10 family."
