1 1 Amend Senate File 2258 as follows:
1 2 #1. Page 2, by inserting after line 35 the
1 3 following:
1 4 "Sec. ___. Section 124.212, subsection 5, Code
1 5 1999, is amended to read as follows:
1 6 5. EPHEDRINE. Unless specifically excepted in
1 7 paragraph "b", or "c", or listed in another schedule,
1 8 any material, compound, mixture, or preparation which
1 9 contains any quantity of the following substance,
1 10 including its salts, optical isomers, and salts of
1 11 such optical isomers:
1 12 a. Ephedrine.
1 13 b. The following drug products containing
1 14 ephedrine, its salts, optical isomers, and salts of
1 15 such optical isomers are excepted from this schedule,
1 16 if they may lawfully be sold over the counter without
1 17 a prescription under the federal Food, Drug and
1 18 Cosmetic Act; are labeled and marketed in a manner
1 19 consistent with the pertinent over-the-counter
1 20 tentative final or final monograph; are manufactured
1 21 and distributed for legitimate medicinal use in a
1 22 manner that reduces or eliminates the likelihood of
1 23 abuse; and are not marketed, advertised, or labeled
1 24 for the indication of stimulation, mental alertness,
1 25 weight loss, muscle enhancement, appetite control, or
1 26 energy:
1 27 (1) Solid oral dosage forms, including soft
1 28 gelatin capsules, that combine active ingredients in
1 29 the following range for each dosage unit of not less
1 30 than twelve and five-tenths milligrams but not more
1 31 than twenty-five milligrams of ephedrine and not less
1 32 than four hundred milligrams of guaifenesin packaged
1 33 in blister packs of not more than two tablets per
1 34 blister.
1 35 (2) Anorectal preparations containing less than
1 36 five percent ephedrine.
1 37 c. Drug products are also excepted from this
1 38 schedule if the drug products are not otherwise
1 39 prohibited by any other law and are naturally
1 40 occurring ephedrine alkaloids or their salts, isomers,
1 41 or salts of isomers, or a combination of these
1 42 substances that are contained in a matrix of organic
1 43 material and do not exceed fifteen percent of the
1 44 total weight of the natural product."
