PAG LIN 1 1 Amend House File 656, as passed by the House, as 1 2 follows: 1 3 #1. Page 12, by inserting before line 13, the 1 4 following: 1 5 "Sec. . Section 49.53, unnumbered paragraph 1, 1 6 Code 1999, is amended to read as follows: 1 7 The commissioner shall not less than four nor more 1 8 than twenty days before the day of each election, 1 9 except those for which different publication 1 10 requirements are prescribed by law, publish notice of 1 11 the election. The notice shall contain a facsimile of 1 12 the portion of the ballot containing the first 1 13 rotation as prescribed by section 49.31, subsection 2, 1 14 and shall show the names of all candidates or nominees 1 15 and the office each seeks, and all public questions, 1 16 to be voted upon at the election. The sample ballot 1 17 published as a part of the notice may at the 1 18 discretion of the commissioner be reduced in size 1 19 relative to the actual ballot but such reduction shall 1 20 not cause upper case letters appearing on the 1 21 published sample ballot to be less thanfive thirty-1 22sixths of an inch high in candidates' names or in1 23summaries of public measuresthe minimum type sizes 1 24 required in section 49.57. The notice shall also 1 25 state the date of the election, the hours the polls 1 26 will be open, the location of each polling place at 1 27 which voting is to occur in the election, the location 1 28 of the polling places designated as early ballot pick- 1 29 up sites, and the names of the precincts voting at 1 30 each polling place, but the statement need not set 1 31 forth any fact which is apparent from the portion of 1 32 the ballot appearing as a part of the same notice. 1 33 The notice shall include the full text of all public 1 34 measures to be voted upon at the election. The notice 1 35 shall also include notice of testing required pursuant 1 36 to sections 52.9, 52.35, and 52.38." 1 37 #2. Page 16, by inserting after line 18 the 1 38 following: 1 39 "Sec. . Section 50.19, unnumbered paragraph 2, 1 40 Code 1999, is amended to read as follows: 1 41 Material pertaining to elections for federal 1 42 offices, including voted ballots, precinct election 1 43 registers, declarations of eligibility signed by 1 44 voters, documents relating to absentee ballots, and 1 45 challenges of voters, shall be preserved for twenty- 1 46 two months after the election. If a contest is not 1 47 pending the materials may be destroyed at the end of 1 48 the retention period. 1 49 Sec. . Section 50.19, Code 1999, is amended by 1 50 adding the following new unnumbered paragraph: 2 1 NEW UNNUMBERED PARAGRAPH. Unvoted ballots for all 2 2 elections may be destroyed ten days following the 2 3 deadline to contest the election for which the ballots 2 4 were prepared or the day after final determination of 2 5 all pending contests of the election for which the 2 6 ballots were prepared, whichever is later." 2 7 #3. Page 19, by inserting after line 1, the 2 8 following: 2 9 Sec. . Section 53.2, unnumbered paragraph 1, 2 10 Code 1999, is amended to read as follows: 2 11 Any registered voter, under the circumstances 2 12 specified in section 53.1, may on any day, except 2 13 election day, and not more than seventy days prior to 2 14 the date of the election, apply in person for an 2 15 absentee ballot at the commissioner's office or at any 2 16 location designated by the commissioner, or make 2 17 written application to the commissioner for an 2 18 absentee ballot. However, for those elections in 2 19 which the commissioner directs the polls be opened at 2 20 noon pursuant to section 49.73, a voter may apply in 2 21 person for an absentee ballot at the commissioner's 2 22 office from eight a.m. until eleven a.m. on election 2 23 day. The state commissioner shall prescribe a form 2 24 for absentee ballot applications. However, if a 2 25 registered voter submits an application that includes 2 26 all of the information required in this section, the 2 27 prescribed form is not required. Absentee ballot 2 28 applications may include instructions to send the 2 29 application directly to the county commissioner of 2 30 elections. However, no absentee ballot application 2 31 shall be preaddressed or printed with instructions to 2 32 send the applications to anyone other than the 2 33 appropriate commissioner." 2 34 #4.
