  1  1    Amend Senate File 2395 as follows:
  1  2    #1.  Page 1, by inserting after line 29 the
  1  3 following:
  1  4    "6A.  Standards for information technology must be
  1  5 developed and implemented to ensure the appropriate
  1  6 acquisition of information technology and to
  1  7 effectively manage the state's information technology
  1  8 resources."
  1  9    #2.  Page 2, by striking line 23 and inserting the
  1 10 following:
  1 11    "a.  The office of the governor or the office of an
  1 12 elective constitutional or statutory officer."
  1 13    #3.  Page 5, by inserting after line 3 the
  1 14 following:
  1 15    "   .  Recommending standards for an electronic
  1 16 repository for maintaining mandated agency reports as
  1 17 provided in section 304.13A.  Such repository shall be
  1 18 developed and maintained for the purpose of providing
  1 19 public access to such mandated reports.  The
  1 20 department shall develop such standards in
  1 21 consultation with the state librarian."
  1 22    #4.  Page 5, by inserting after line 10 the
  1 23 following:
  1 24    "___.  Coordinating the acquisition of information
  1 25 technology by participating agencies in furtherance of
  1 26 the purposes of this chapter."
  1 27    #5.  Page 5, line 29, by inserting after the word
  1 28 "state." the following:  "It is the intent of the
  1 29 general assembly that the general assembly make
  1 30 amounts collected as fees pursuant to this subsection
  1 31 available to the department for the department's
  1 32 operational expenses.  Such amounts shall not be
  1 33 available to the department except pursuant to
  1 34 enactment by the general assembly which is signed by
  1 35 the governor."

  1 37 chairperson".
  1 38    #7.  Page 9, by inserting after line 6 the
  1 39 following:
  1 40    "The information technology council shall elect its
  1 41 own chairperson from among the voting members of the
  1 42 council."
  1 43    #8.  Page 11, line 18, by striking the word
  1 44 "director" and inserting the following:  "governor".
  1 45    #9.  Page 11, line 20, by striking the words "a
  1 46 three-year term" and inserting the following:  "at the
  1 47 pleasure of the governor, except that an administrator
  1 48 shall not serve for a term greater than three years
  1 49 unless reappointed by the governor".
  1 50    #10.  Page 13, by inserting after line 2 the
  2  1 following:  "It is the intent of the general assembly
  2  2 that information technology standards be established
  2  3 for the purpose of guiding such procurements, but such
  2  4 standards shall not be mandatory on any participating
  2  5 agency until approved by act of the general assembly
  2  6 affirmatively approving such standards.
  2  7    The office of the governor or the office of an
  2  8 elective constitutional or statutory officer shall
  2  9 consult with the department prior to procuring
  2 10 information technology and consider the standards
  2 11 recommended by the council, and provide a written
  2 12 report to the department relating to the office's
  2 13 decision regarding such acquisitions."
  2 14    #11.  Page 13, line 13, by striking the word
  2 15 "establishing" and inserting the following:
  2 16 "recommending".
  2 17    #12.  Page 13, line 16, by inserting after the word
  2 18 "source." the following:  "The information technology
  2 19 council, in recommending such fees, shall also
  2 20 consider the collection of an enhanced fee for
  2 21 accessing government information or engaging in
  2 22 transactions with governmental entities which occur
  2 23 through IowAccess and where a fee is already charged
  2 24 for such access or transaction.  It is the intent of
  2 25 the general assembly that the fees charged for
  2 26 services provided through IowAccess be reasonable, but
  2 27 set at levels necessary to generate sufficient revenue
  2 28 to cover the operational costs of IowAccess.  It is
  2 29 also the intent of the general assembly that fees be
  2 30 charged for a sufficient number of differing types of
  2 31 access or transactions in an effort to maintain a
  2 32 lower overall level of the fees to be charged."
  2 33    #13.  Page 16, by inserting after line 22 the
  2 34 following:
  2 35    "Sec.    .  Section 11.5B, Code 1999, is amended by
  2 36 adding the following new subsection:
  2 37    NEW SUBSECTION.  14.  Information technology
  2 38 department.
  2 39    Sec.    .  Section 304.3, Code 1999, is amended by
  2 40 adding the following new subsection:
  2 41    NEW SUBSECTION.  9.  The director of the
  2 42 information technology department.
  2 43    Sec.    .  Section 304.7, Code 1999, is amended by
  2 44 adding the following new subsection:
  2 45    NEW SUBSECTION.  1A.  Public records policies for
  2 46 an electronic repository for mandated agency reports.
  2 47    Sec.    .  NEW SECTION.  304.13A  ELECTRONIC
  2 48 RECORDS.
  2 49    1.  An agency required to compile and maintain a
  2 50 report, on and after July 1, 2001, shall maintain such
  3  1 report in an electronic form, giving consideration to
  3  2 the standards for electronic records recommended by
  3  3 the information technology department.  Such agency,
  3  4 by itself, or with the assistance of the information
  3  5 technology department, shall also make the report
  3  6 accessible to the public through the internet as
  3  7 provided in subsection 2 and through other electronic
  3  8 means.
  3  9    2.  A copy of all required agency reports shall be
  3 10 located at an internet site maintained by the
  3 11 information technology department in consultation with
  3 12 the state librarian, and all required reports shall be
  3 13 placed on electronic media.  The state librarian shall
  3 14 provide for the distribution of such copies to a
  3 15 public library in this state requesting such copy.
  3 16    For purposes of this section, "public library"
  3 17 means a city library, a regional library as provided
  3 18 in chapter 256, or a county library as provided in
  3 19 chapter 336.
  3 20    3.  It is the intent of the general assembly that
  3 21 this section be interpreted to reduce, to the greatest
  3 22 extent possible, printed copies of agency reports
  3 23 while protecting the public's right to have access to
  3 24 such reports.  It is the intent of the general
  3 25 assembly that the distribution of a printed mandatory
  3 26 report be used only when it is the most efficient and
  3 27 cost-effective method for providing public access to
  3 28 such report.  It is the intent of the general assembly
  3 29 that agency reports subject to this section be made
  3 30 available, to the greatest extent possible, to the
  3 31 public by electronic means.
  3 32    4.  The commission, in consultation with the
  3 33 information technology department, shall make
  3 34 recommendations to the governor and the general
  3 35 assembly for the continued reduction of printed
  3 36 reports throughout state government in a manner that
  3 37 protects the public's right to access such reports."
