  1  1    Amend Senate File 2411 as follows:
  1  2    #1.  Page 78, by inserting after line 29 the
  1  3 following:
  1  4    Sec. 301.  PARTICIPATION IN HEALTH OR MEDICAL
  1  5 INSURANCE PROGRAMS BY RETIREES AGE FIFTY-FIVE OR
  1  6 OLDER.
  1  7    1.  As used in this section, unless the context
  1  8 otherwise requires:
  1  9    a.  "Health or medical insurance program" means a
  1 10 health or medical group insurance plan for employees
  1 11 of the state.
  1 12    b.  "Member" means an employee of the executive
  1 13 branch of the state or the judicial branch of the
  1 14 state who is a member of the Iowa public employees'
  1 15 retirement system or the Iowa department of public
  1 16 safety peace officers' retirement, accident, and
  1 17 disability system, who at the date of termination of
  1 18 employment is receiving full health or medical
  1 19 insurance benefits pursuant to a health or medical
  1 20 insurance program in which the state makes
  1 21 contributions, and is not receiving disability
  1 22 payments under the state employees' disability
  1 23 insurance program, and who is not a member of the
  1 24 general assembly.  "Member" does not mean an employee
  1 25 of the state board of regents.
  1 26    2.  A member with at least twenty years of
  1 27 membership service who retires on or after July 10,
  1 28 2000, and before February 1, 2001, who applies to
  1 29 receive retirement benefits under this Act prior to
  1 30 February 1, 2001, who has attained at least the age of
  1 31 fifty-five at the time of retirement, and who was a
  1 32 participant in a health or medical insurance program
  1 33 in which the state makes contributions at the time of
  1 34 retirement, may continue to participate in the health
  1 35 or medical insurance program in which the member is
  1 36 enrolled on April 3, 2000, as authorized by law.
  1 37 However, a member may choose to participate in a
  1 38 health or medical insurance program after April 3,
  1 39 2000, which incurs less cost to the state.
  1 40 Notwithstanding any other provision of law to the
  1 41 contrary, the member shall remain eligible to
  1 42 participate in a health or medical insurance program
  1 43 as provided by this section and the state shall
  1 44 continue to pay the employer's portion of the premium
  1 45 at the cost existing at the time of retirement under
  1 46 the program for the retiree until the retiree attains
  1 47 the age of sixty-five.  Any additional premium costs
  1 48 for coverage incurred after the time of retirement
  1 49 shall be paid by the retiree.  However, in order to
  1 50 have the state continue to pay the employer's portion
  2  1 of the premium, the member must send written
  2  2 notification to the department of personnel at any
  2  3 time after the effective date of this section and
  2  4 prior to November 1, 2000, of the intent to retire and
  2  5 the anticipated date of retirement.
  2  6    3.  If a member continues participation in a health
  2  7 or medical insurance program and the state pays
  2  8 premiums as authorized in subsection 2, the member is
  2  9 not eligible to accept further employment in which the
  2 10 state or a political subdivision of the state is the
  2 11 employer.  However, this subsection shall not apply to
  2 12 a member who is elected to a public office as defined
  2 13 in chapter 56.
  2 14    4.  A state department shall not be required to
  2 15 delete more than its proportionate share of all
  2 16 general fund full-time equivalent positions vacated
  2 17 due to the incentive for retirement established in
  2 18 subsection 2.  All positions vacated by a member
  2 19 exercising the rights established in subsection 2
  2 20 shall be deleted, and the savings, as determined by
  2 21 the department of management, shall revert to the
  2 22 originating fund in a manner specified by the
  2 23 department of management, except that the portion of
  2 24 the savings which represents the cost of the
  2 25 employer's portion of a member's premium payable under
  2 26 this section shall not revert but shall be transferred
  2 27 to the department of revenue and finance to defray the
  2 28 costs of implementing this section.  A state
  2 29 department may use a portion of the savings related to
  2 30 a deleted position to purchase technology or other
  2 31 equipment if the department of management determines
  2 32 that this purchase is necessary to maintain necessary
  2 33 levels of service for the state department.  However,
  2 34 if an affected department determines that the vacancy
  2 35 may be detrimental to critical services provided to
  2 36 the public, the affected department may, with the
  2 37 approval of the department of management, exchange the
  2 38 vacancy with a position or positions determined by the
  2 39 department of management to be of an equal value, and
  2 40 delete that position or positions.  If a position is
  2 41 not available for exchange, the department may, with
  2 42 the approval of the director of the department of
  2 43 management, retain and fill the vacancy.  It is the
  2 44 intent of the general assembly that retirement taken
  2 45 pursuant to this section be used to eliminate the
  2 46 greatest number of employment positions as is
  2 47 feasible.  The department of management shall report
  2 48 to the fiscal committee of the legislative council and
  2 49 legislative fiscal bureau the number of vacancies
  2 50 retained and filled pursuant to this subsection.
  3  1    It is the intent of the general assembly that the
  3  2 cost of premiums incurred by a state department be
  3  3 included within that department's annual budget and be
  3  4 paid from originating funds.
  3  5    Sec.    .  EFFECTIVE DATE.  Section 301 of this
  3  6 Act, being deemed of immediate importance, takes
  3  7 effect upon enactment."
