  1  1    Amend House File 772, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 29, by inserting after line 10 the
  1  4 following:
  1  5    "Sec.    .  Section 414.1, Code 1999, is amended to
  1  6 read as follows:
  1  7    414.1  BUILDING RESTRICTIONS – POWERS GRANTED.
  1  8    1.  For the purpose of promoting the health,
  1  9 safety, morals, or the general welfare of the
  1 10 community or for the purpose of preserving
  1 11 historically significant areas of the community, any
  1 12 city is hereby empowered to regulate and restrict the
  1 13 height, number of stories, and size of buildings and
  1 14 other structures, the percentage of lot that may be
  1 15 occupied, the size of yards, courts, and other open
  1 16 spaces, the density of population, and the location
  1 17 and use of buildings, structures, and land for trade,
  1 18 industry, residence, or other purposes.
  1 19    2.  The city of Des Moines may, for the purpose of
  1 20 preserving the dominance of the dome of the state
  1 21 capitol building and the view of the state capitol
  1 22 building from prominent public viewing points,
  1 23 regulate and restrict the height and size of buildings
  1 24 and other structures in the city of Des Moines.  Any
  1 25 regulations pertaining to such matters shall be made
  1 26 in accordance with a comprehensive plan and in
  1 27 consultation with the capitol planning commission."
  1 28    #2.  By renumbering and correcting internal
  1 29 references as necessary.
