Section 8.57, subsection 5, paragraph 1 6 e, Code 1999, is amended to read as follows: 1 7 e. Notwithstanding provisions to the contrary in 1 8 sections 99D.17 and 99F.11, for each of the fiscal 1 9 years in the fiscal period beginning July 1, 1995, and 1 10July 1, 1996,ending June 30, 1999, not more than a 1 11 total of sixty million dollars; for the fiscal year 1 12 beginning July 1, 1999, not more than fifty million 1 13 dollars; and for the fiscal year beginning July 1, 1 14 2000, and for each fiscal year thereafter, not more 1 15 than forty million dollars; shall be deposited in the 1 16 general fund of the state in any fiscal year pursuant 1 17 to sections 99D.17 and 99F.11. The total moneys in 1 18 excess of the moneys deposited in the general fund in 1 19 a fiscal year shall be deposited in the infrastructure 1 20 fund and shall be used as provided in this section, 1 21 notwithstanding section 8.60." 1 22 #2. Page 29, by inserting after line 5 the 1 23 following: 1 24 "Sec. . NEW SECTION. 256.29 PHYSICAL PLANT 1 25 AND EQUIPMENT LEVY STATE AID PROGRAM APPROPRIATION. 1 26 1. There is appropriated from the rebuild Iowa 1 27 infrastructure fund to the department of education the 1 28 following amounts for the following fiscal years for 1 29 allocation to school districts under the physical 1 30 plant and equipment levy state aid program: 1 31 a. For the fiscal year beginning July 1, 1999, and 1 32 ending June 30, 2000, the sum of ten million dollars. 1 33 b. For the fiscal year beginning July 1, 2000, and 1 34 ending June 30, 2001, the sum of twenty million 1 35 dollars. 1 36 c. It is the intent of the general assembly to 1 37 increase by ten million dollars annually the amount 1 38 appropriated in paragraph "b", until the total amount 1 39 appropriated annually for purposes of the physical 1 40 plant and equipment levy state aid program reaches 1 41 fifty million dollars. 1 42 2. The purpose of the physical plant and equipment 1 43 levy state aid program is to provide a means for Iowa 1 44 schools to reduce their long-term borrowing costs and 1 45 thus reduce costs to taxpayers. A school district 1 46 shall expend funds received pursuant to this section 1 47 for a project as defined in subsection 3. 1 48 3. For purposes of this section, "project" means 1 49 any undertaking by a school district for which 1 50 expenditures are authorized under chapter 298, 2 1 including all costs and expenses associated with 2 2 authorization for, and commencement of, a project. 2 3 "School district" means a public school corporation 2 4 organized under chapter 274. 2 5 4. The department shall determine the physical 2 6 plant and equipment levy state aid per pupil by 2 7 multiplying the regular program state cost per pupil 2 8 by five percent minus the district assessed valuation 2 9 per budget pupil multiplied by thirty-three cents per 2 10 one thousand dollars assessed valuation. The total 2 11 physical plant and equipment levy state aid shall be 2 12 determined by multiplying the district's budget 2 13 enrollment for the budget year by the district's 2 14 physical plant and equipment levy state aid per pupil. 2 15 However, if the amount appropriated in subsection 1 2 16 for a given year is insufficient to provide the full 2 17 amount of physical plant and equipment levy state aid, 2 18 the amount of physical plant and equipment levy state 2 19 aid allocated to each district from the appropriation 2 20 made in subsection 1 shall be equal to the percentage 2 21 that the physical plant and equipment levy state aid 2 22 for the district bears to the total amount of physical 2 23 plant and equipment levy state aid of all districts in 2 24 the state. 2 25 5. For each year in which an appropriation is made 2 26 to the physical plant and equipment levy state aid 2 27 program, the allocation to each school district shall 2 28 be made in one payment on or about October 15 of the 2 29 fiscal year for which the appropriation is made, 2 30 taking into consideration the relative budget and cash 2 31 position of the state resources. Moneys received 2 32 under this section shall not be commingled with state 2 33 aid payments made under section 257.16 to a school 2 34 district and shall be accounted for by the local 2 35 school district separately from state aid payments. 2 36 Payments made to school districts under this section 2 37 are miscellaneous income for purposes of chapter 257." 2 38 #3.
