  1  1    Amend House File 760 as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 23, by inserting after line 20, the
  1  4 following:
  1  5    "4.  Contingent upon receipt of tobacco settlement
  1  6 moneys, a portion of the moneys deposited in the
  1  7 tobacco settlement fund are appropriated to the
  1  8 department and notwithstanding section 12.65, the
  1  9 department shall use a necessary amount of moneys to
  1 10 provide family coverage under the state children's
  1 11 health insurance program to families who are not
  1 12 eligible for medical assistance pursuant to chapter
  1 13 249A and whose family income does not exceed one
  1 14 hundred fifty percent of the federal poverty level, as
  1 15 defined in 42 U.S.C. } 9902(2), including any revision
  1 16 required by that federal law.  Any copayment amount
  1 17 shall comply with federal requirements and shall not
  1 18 exceed five percent of the annual family income."
