PAG LIN 1 1 Amend Senate File 470 as follows: 1 2 #1. Page 5, by inserting before line 16 the 1 3 following: 1 4 "Sec. 101. NEW SECTION. 56.6A VOLUNTARY LIMITS 1 5 ON CONTRIBUTIONS AND EXPENDITURES. 1 6 1. A candidate for the general assembly may file a 1 7 declaration of limitation on expenditures pursuant to 1 8 section 56.6B, certifying that the candidate and the 1 9 candidate's committee will not do any of the 1 10 following: 1 11 a. Make expenditures during an election campaign 1 12 cycle exceeding the following amounts: 1 13 (1) Fifty thousand dollars for a candidate for the 1 14 senate. 1 15 (2) Twenty-five thousand dollars for a candidate 1 16 for the house of representatives. 1 17 b. Accept direct contributions from a state, 1 18 county, or city statutory political committee or a 1 19 national political party. 1 20 2. A candidate who has filed a declaration of 1 21 limitation on expenditures pursuant to section 56.6B 1 22 shall not be bound by the declaration if any opposing 1 23 candidate for the same office has not filed a 1 24 declaration of limitation on expenditures pursuant to 1 25 section 56.6B, or has filed a declaration but has made 1 26 expenditures exceeding the applicable limit. 1 27 3. For the purposes of this section and section 1 28 56.6B: 1 29 a. "Election campaign cycle" means the period of 1 30 time between any general or special election 1 31 commencing on the day following the previous election 1 32 for that office, and continuing through election day. 1 33 b. "Expenditures" shall include all amounts 1 34 reported in disclosure reports pursuant to section 1 35 56.6, subsection 3, paragraph "g", as well as any 1 36 amounts attributed to a candidate pursuant to section 1 37 56.13. 1 38 Sec. 102. NEW SECTION. 56.6B DECLARATION OF 1 39 LIMITATION ON EXPENDITURES. 1 40 1. A declaration of limitation on expenditures 1 41 shall meet the requirements of section 56.6A, 1 42 subsection 1, and shall include the signature of the 1 43 candidate. 1 44 2. A declaration of limitation on expenditures 1 45 shall be filed with the board no later than the date 1 46 upon which the candidate makes a filing pursuant to 1 47 section 43.11, 44.1, or 45.4 to have the candidate's 1 48 name placed on a ballot for election to public office. 1 49 3. Once a declaration of limitation on 1 50 expenditures has been filed, a candidate's 2 1 expenditures may be challenged pursuant to the 2 2 procedure in section 68B.32B. Notwithstanding the 2 3 requirements of that section, the board shall, within 2 4 twenty-four hours of the filing of a complaint, 2 5 determine whether there is probable cause to believe 2 6 the existence of facts that would establish an 2 7 unreported expenditure, an improperly reported 2 8 expenditure, or aggregate expenditures exceeding the 2 9 applicable limit. The board shall proceed with the 2 10 remainder of the complaint procedure only upon a 2 11 finding of probable cause. 2 12 4. a. A finding by the board that a candidate has 2 13 exceeded the applicable expenditure limit shall not 2 14 subject the candidate to any criminal penalty under 2 15 this chapter, but shall release the candidate's 2 16 opponent from any obligation to comply with that 2 17 candidate's own declaration of limitation of 2 18 expenditures. 2 19 b. A finding by the board that the candidate has 2 20 not reported or has improperly reported an expenditure 2 21 shall result in appropriate adjustment of the 2 22 candidate's reported expenditures, and may subject the 2 23 candidate to penalties pursuant to section 56.16." 2 24 #2.
