Section 68B.35, subsections 2, 4, and 1 5 5, Code 1999, are amended to read as follows: 1 6 2. The financialstatementinformation requiredby1 7this sectionunder subsection 1 shall be filed by the 1 8 following persons: 1 9a. Any statewide elected official.1 10b.a. The executive or administrative head or 1 11 heads of any agency of state government. 1 12c.b. The deputy executive or administrative head 1 13 or heads of an agency of state government. 1 14d.c. The head of a major subunit of a department 1 15 or independent state agency whose position involves a 1 16 substantial exercise of administrative discretion or 1 17 the expenditure of public funds as defined under rules 1 18 adopted by the board, pursuant to chapter 17A, in 1 19 consultation with the department or agency. 1 20e.d. Members of the banking board, the ethics and 1 21 campaign disclosure board, the credit union review 1 22 board, the economic development board, the employment 1 23 appeal board, the environmental protection commission, 1 24 the health facilities council, the Iowa business 1 25 investment corporation board of directors, the Iowa 1 26 finance authority, the Iowa seed capital corporation, 1 27 the Iowa public employees' retirement system 1 28 investment board, the lottery board, the natural 1 29 resource commission, the board of parole, the 1 30 petroleum underground storage tank fund board, the 1 31 public employment relations board, the state racing 1 32 and gaming commission, the state board of regents, the 1 33 tax review board, the transportation commission, the 1 34 office of consumer advocate, the utilities board, the 1 35 Iowa telecommunications and technology commission, and 1 36 any full-time members of other boards and commissions 1 37 as defined under section 7E.4 who receive an annual 1 38 salary for their service on the board or commission. 1 39f. Members of the general assembly.1 40g. Candidates for state office.1 41h.e. Legislative employees who are the head or 1 42 deputy head of a legislative agency or whose position 1 43 involves a substantial exercise of administrative 1 44 discretion or the expenditure of public funds. 1 45 4. The ethics committee of each house of the 1 46 general assembly shall recommend rules for adoption by 1 47 each house for the time and manner for the filing of 1 48 financial statements by members or employees of the 1 49 particular house. The legislative council shall adopt 1 50 rules for the time and manner for the filing of 2 1 financial statements by legislative employees of the 2 2 central legislative staff agencies. The rules shall 2 3 provide for the filing of the financial statements 2 4 with either the chief clerk of the house, the 2 5 secretary of the senate, or other appropriate person 2 6 or body. The rules shall provide that financial 2 7 statements filed by members of each house reflect 2 8 information which is current as of the time of filing 2 9 the financial statement and for amendment of the 2 10 information if the information changes during the time 2 11 period covered by the financial statement. 2 12 5. A candidate for statewide office shall file a 2 13 financial statement with the ethics and campaign 2 14 disclosure board, a candidate for the office of state 2 15 representative shall file a financial statement with 2 16 the chief clerk of the house of representatives, and a 2 17 candidate for the office of state senator shall file a 2 18 financial statement with the secretary of the senate. 2 19 Statements shall contain information concerning the 2 20 yearpreceding the yearin which the election is to be 2 21 held. The statement shall be filed no later than 2 22 thirty days after the date on which a person is 2 23 required to file nomination papers for state office 2 24 under section 43.11, or, if the person is a candidate 2 25 in a special election, as soon as practicable after 2 26 the certification of the name of the nominee under 2 27 section 43.88, but the statement shall be postmarked 2 28 no later than seven days after certification. The 2 29 ethics and campaign disclosure board shall adopt rules 2 30 pursuant to chapter 17A providing for the filing of 2 31 the financial statements with the board and for the 2 32 deposit, retention, and availability of the financial 2 33 statements. The rules shall provide for amendment of 2 34 the information contained in the financial statements 2 35 if the information changes during the time period 2 36 covered by the financial statement. The ethics 2 37 committees of the house of representatives and the 2 38 senate shall recommend rules for adoption by the 2 39 respective houses providing for the filing of the 2 40 financial statements with the chief clerk of the house 2 41 or the secretary of the senate and for the deposit, 2 42 retention, and availability of the financial 2 43 statements. The rules shall provide for amendment of 2 44 the information contained in the financial statements 2 45 if the information changes during the time period 2 46 covered by the financial statement. Rules adopted 2 47 shall also include a procedure for notification of 2 48 candidates of the duty to filedisclosurefinancial 2 49 statements under this section. 2 50 Sec. . Section 68B.35, Code 1999, is amended by 3 1 adding the following new subsections: 3 2 NEW SUBSECTION. 2A. A statewide elected official, 3 3 members of the general assembly, and candidates for 3 4 state office shall file financial statements which 3 5 contain all of the following: 3 6 a. The name of any business, organization, or 3 7 entity in which the official, member, or candidate is 3 8 employed. If the official, member, or candidate is 3 9 self-employed and is doing business under the 3 10 official's, member's, or candidate's given name, the 3 11 official, member, or candidate shall indicate that the 3 12 person is self-employed. If the official, member, or 3 13 candidate is self-employed, and is doing business 3 14 under a name other than the official's, member's, or 3 15 candidate's given name, the official, member, or 3 16 candidate shall indicate that the person is self- 3 17 employed and list the name of the person's business. 3 18 If the official, member, or candidate is not employed 3 19 by another person or is not self-employed, the person 3 20 shall indicate that the person is not employed. 3 21 b. The nature of the business in which the 3 22 official, member, or candidate is employed or self- 3 23 employed, if the official, member, or candidate is 3 24 employed or self-employed. 3 25 c. The job title or position held within any 3 26 business in which the official, member, or candidate 3 27 is employed or self-employed. 3 28 d. If the official, member, or candidate is 3 29 employed or self-employed, the range in which annual 3 30 compensation received or earned falls, in the 3 31 following ranges: 3 32 (1) $ 0 through $9,999.99. 3 33 (2) $ 10,000 through $24,999.99. 3 34 (3) $ 25,000 through $49,999.99. 3 35 (4) $ 50,000 through $99,999.99. 3 36 (5) $100,000 through $149,999.99. 3 37 (6) $150,000 through $249,999.99. 3 38 (7) $250,000 through $499,999.99. 3 39 (8) $500,000 through $999,999.99. 3 40 (9) $1,000,000 and above. 3 41 e. The information required in paragraphs "a" 3 42 through "d", where applicable, for the spouse of the 3 43 official, member, or candidate. 3 44 f. A list of any other sources of income and type 3 45 of interest held, if the source produces more than one 3 46 thousand dollars annually in gross income. The list 3 47 shall include the name of the corporation, business, 3 48 or other entity from which the income is derived and, 3 49 if not apparent from the name, the nature of the 3 50 business of the corporation, business, or other entity 4 1 from which the income is derived. The type of 4 2 interest held may be listed under any of the following 4 3 categories, or under any other categories as may be 4 4 established by rule: 4 5 (1) Securities. 4 6 (2) Instruments of financial institutions. 4 7 (3) Trusts. 4 8 (4) Real estate. 4 9 (5) Retirement systems. 4 10 (6) Other types of income or income categories 4 11 specified in state and federal income tax regulations. 4 12 NEW SUBSECTION. 6. The secretary of the senate 4 13 and the chief clerk of the house shall forward copies 4 14 of any personal financial disclosure statements 4 15 received from members of and candidates for the 4 16 general assembly to the ethics and campaign disclosure 4 17 board. The board shall add the information to any 4 18 files maintained which pertain to the particular 4 19 member of or candidate for the general assembly and 4 20 shall add the information, when possible, to any 4 21 electronic databases or files which are publicly 4 22 accessible from remote locations." 4 23 #2.
