  1  1    Amend House File 476, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 10, by inserting after line 2 the
  1  4 following:
  1  5    "Sec.    .  Section 6B.17, Code 1999, is amended to
  1  6 read as follows:
  1  7    6B.17  WHEN APPRAISEMENT FINAL.
  1  8    The appraisement of damages returned by the
  1  9 commissioners shall be final unless appealed from by
  1 10 the condemnee.
  1 11    Sec.    .  Section 6B.18, Code 1999, is amended to
  1 12 read as follows:
  1 13    6B.18  NOTICE OF APPRAISEMENT – APPEAL OF AWARD.
  1 14    After the appraisement of damages has been
  1 15 delivered to the sheriff by the compensation
  1 16 commission, the sheriff shall give written notice, by
  1 17 ordinary mail, to the condemner and the condemnee of
  1 18 the date on which the appraisement of damages was
  1 19 made, the amount of the appraisement, and that any
  1 20 interested party the condemnee only may, within thirty
  1 21 days from the date of mailing the notice of the
  1 22 appraisement of damages, appeal to the district court.
  1 23 The sheriff shall endorse the date of mailing of
  1 24 notice upon the original appraisement of damages.  At
  1 25 the time of appeal, the appellant shall give written
  1 26 notice that the appeal has been taken to the adverse
  1 27 party, or the adverse party's agent or attorney,
  1 28 lienholders, and the sheriff.
  1 29    Sec.    .  Section 6B.21, Code 1999, is amended to
  1 30 read as follows:
  1 31    6B.21  APPEALS – HOW DOCKETED AND TRIED.
  1 32    The appeal shall be docketed in the name of the
  1 33 person appealing and all other interested parties to
  1 34 the action shall be defendants.  In the event the
  1 35 condemner and the condemnee appeal, the appeal shall
  1 36 be docketed in the name of the appellant which filed
  1 37 the application for condemnation and all other parties
  1 38 to the action shall be defendants.  The appeal shall
  1 39 be tried as in an action by ordinary proceedings.  The
  1 40 appraisement of damages by the compensation commission
  1 41 is admissible in the action."
