1 1 Amend Senate File 414 as follows:
1 2 #1. Page 1, by inserting after line 18 the
1 3 following:
1 4 "Sec. ___. Section 730.5, Code 1999, is amended by
1 5 adding the following new subsection:
1 6 NEW SUBSECTION. 17. EMPLOYER REHABILITATION COST
1 7 FUND.
1 8 a. There is hereby created in the office of the
1 9 treasurer of state a special fund, separate and apart
1 10 from all other public moneys or funds of this state,
1 11 to be known as the "Employer Rehabilitation Cost
1 12 Fund", hereafter called the "fund". The fund shall
1 13 consist of all moneys deposited in the fund pursuant
1 14 to this subsection.
1 15 b. The director of the department of workforce
1 16 development is the trustee of the fund and shall
1 17 administer the fund. Any loss to the fund shall be
1 18 charged against the fund and the director shall not be
1 19 personally liable for such loss. The director shall
1 20 adopt rules to permit employers to apply to the fund
1 21 for reimbursement of the costs of rehabilitation
1 22 incurred by the employer pursuant to subsection 9,
1 23 paragraph "g".
1 24 c. Prior to each calendar year, the director of
1 25 the department of workforce development shall file a
1 26 report with the general assembly providing an estimate
1 27 of the cost of reimbursing employers as provided in
1 28 this subsection for the next calendar year.
1 29 Notwithstanding the provisions of section 2.10 to the
1 30 contrary, each year, the portion of the salary of each
1 31 member of the general assembly necessary to fund the
1 32 estimate of the cost shall be deducted from the salary
1 33 of each member of the general assembly and shall be
1 34 deposited in this fund.
1 35 d. Moneys in the fund are not subject to section
1 36 8.33. Notwithstanding section 12C.7, subsection 2,
1 37 interest or earnings on moneys in the fund shall be
1 38 credited to the fund."
