  1  1    Amend Senate File 451 as follows:
  1  2    #1.  Page 1, by inserting after line 14 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  13B.2A  INDIGENT DEFENSE
  1  5 ADVISORY COMMISSION.
  1  6    An indigent defense advisory commission is
  1  7 established within the department to advise and make
  1  8 recommendations to the legislature and the state
  1  9 public defender regarding the hourly rates paid to
  1 10 court-appointed counsel and per case fee limitations.
  1 11 These recommendations shall be consistent with the
  1 12 constitutional requirement to provide effective
  1 13 assistance of counsel to those indigent persons for
  1 14 whom the state is required to provide counsel.
  1 15    The advisory commission shall consist of five
  1 16 members.  The governor shall appoint three members,
  1 17 including one member from nominations by the Iowa
  1 18 state bar association and one member from nominations
  1 19 by the supreme court.  Two members, one from each
  1 20 chamber of the general assembly, shall be appointed,
  1 21 with no more than one appointed from the same
  1 22 political party.  Each member shall serve a three-year
  1 23 term, with initial terms to be staggered.  No more
  1 24 than three members shall be licensed to practice law
  1 25 in Iowa.  The state public defender shall serve as an
  1 26 ex officio member of the commission and shall serve as
  1 27 the nonvoting chair of the commission.
  1 28    The members of the commission are entitled to
  1 29 receive reimbursement for actual expenses incurred as
  1 30 provided for in section 7E.6, subsection 2 while
  1 31 engaged in the performance of the duties of the
  1 32 commission.
  1 33    The advisory commission shall file a written report
  1 34 every three years with the governor and the general
  1 35 assembly by January 1 of a year in which a report is
  1 36 due regarding the recommendations and activities of
  1 37 the commission.  The first such report shall be due on
  1 38 January 1, 2003."

  1 40 "supervisors" the following:  "in substantially the
  1 41 same manner as provided in section 815.7".

  2  7    #8.  Page 8, lines 17 and 18, by striking the words
  2  8 "in the" and inserting the following:  "in
  2  9 substantially the same".
  2 10    #9.  Page 8, line 18, by inserting after the word
  2 11 "supervisors" the following:  "as provided in section
  2 12 815.7".
  2 13    #10.  Page 9, line 1, by striking the word
  2 14 "reimbursed" and inserting the following:  "reimbursed
  2 15 paid".
  2 16    #11.  Page 12, line 8, by inserting after the word
