1 1 Amend Senate File 264 as follows:
1 2 #1. Page 1, by striking lines 3 through 14 and
1 3 inserting the following:
1 4 "NEW SUBSECTION. 4. The department and the
1 5 commission shall exercise regulatory authority
1 6 regarding seasons, bag limits, possession limits,
1 7 locality, the method of taking, or the taking of fish
1 8 and wildlife by members of the Sac and Fox tribe of
1 9 the Mississippi in Iowa within the boundaries of the
1 10 Sac and Fox tribe settlement in Tama county only to
1 11 the extent provided in a written agreement between the
1 12 tribal council of the Sac and Fox tribe of the
1 13 Mississippi in Iowa and the department. The written
1 14 agreement shall not be construed to supersede or
1 15 impair the regulatory authority exercised by the
1 16 commission pursuant to the federal Migratory Bird
1 17 Treaty Act, the federal Migratory Bird Stamp Hunting
1 18 Act, the federal Endangered Species Act, or other
1 19 federal law. The department and the commission shall
1 20 not unreasonably fail to enter into an agreement and
1 21 shall pursue such an agreement in an expedient manner.
1 22 This subsection shall become effective upon signing of
1 23 the written agreement by the director of the
1 24 department and the chairperson of the Sac and Fox
1 25 tribe of the Mississippi in Iowa."
