PAG LIN 1 1 Amend House File 224, as passed by the House, as 1 2 follows: 1 3 #1. Page 1, by inserting before line 1 the 1 4 following: 1 5 "Section 1. Section 37.9, unnumbered paragraphs 1 1 6 and 5, Code l999, are amended to read as follows: 1 7 When the proposition to erect any such building or 1 8 monument has been carried by a majority vote, the 1 9 board of supervisors or the city council, as the case 1 10 may be, shall appoint a commission consisting of five 1 11 or seven members, in the manner and with the 1 12 qualifications provided in this chapter, which shall 1 13 have charge and supervision of the erection of the 1 14 building or monument, and when erected, the management 1 15 and control of the building or monument. 1 16 Commencing with the commissioners appointed to take 1 17 office after January 1, 1952,one commissioner shall1 18be appointed for a term of one year, two commissioners1 19shall be appointed for a term of two years, and two1 20commissioners shall be appointed for a term of three1 21years, or in each instance until a successor is1 22appointed and qualifiedthe terms of office of the 1 23 commissioners shall be staggered so that all 1 24 commissioners' terms will not end in the same year. 1 25 Thereafter, the successors in each instance shall hold 1 26 office for a term of three years or until a successor 1 27 is appointed and qualified." 1 28 #2. Page 1, by inserting after line 8 the 1 29 following: 1 30 "Sec. . Section 347.9, Code 1999, is amended to 1 31 read as follows: 1 32 347.9 TRUSTEES APPOINTMENT TERMS OF OFFICE. 1 33 When it has been determined by the voters of a 1 34 county to establish a county public hospital, the 1 35 board shall appoint seven trustees chosen from among 1 36 the resident citizens of the county with reference to 1 37 their fitness for office, and not more than four of 1 38 the trustees shall be residents of the city at which 1 39 the hospital is located. The trustees shall hold 1 40 office until the following general election, at which 1 41 time their successors shall be elected, two for a term 1 42 of two years, two for four years, and three for six 1 43 years, and they shall determine by lot their 1 44 respective terms, and thereafter their successors 1 45 shall be elected for regular terms of six years each. 1 46 A person or spouse of a person with medical or special 1 47 staff privileges in the county public hospital or who 1 48 receives direct or indirect compensation in an amount 1 49 greater than one thousand five hundred dollars in a 1 50 calendar year from the county public hospital or 2 1 direct or indirect compensation in an amount greater 2 2 than one thousand five hundred dollars in a calendar 2 3 year from a person contracting for services with the 2 4 hospital shall not be eligible to serve as a trustee 2 5 for that county public hospital. 2 6 Sec. . Section 347.12, unnumbered paragraph 3, 2 7 Code l999, is amended to read as follows: 2 8 The secretary of the hospital board of trustees 2 9 shall file monthly on or before thetenththirtieth 2 10 day of each month with such board a complete statement 2 11 of all receipts and disbursements from all funds 2 12 during the preceding month, and also the balance 2 13 remaining on hand in such funds at the close of the 2 14 period covered by said statement. 2 15 Sec. . Section 347.13, subsection 7, Code 1999, 2 16 is amended by striking the subsection. 2 17 Sec. . Section 347.13, subsection 11, Code 2 18 1999, is amended by striking the subsection and 2 19 inserting in lieu thereof the following: 2 20 11. Make available to the board of supervisors a 2 21 statement of all receipts and expenditures from the 2 22 preceding fiscal year. 2 23 Sec. . Section 347.14, subsection 11, Code 2 24 1999, is amended to read as follows: 2 25 11. Do all things necessary for the management, 2 26 control and government of said hospital and exercise 2 27 all the rights and duties pertaining to hospital 2 28 trustees generally, including but not limited to 2 29 authorizing delivery of any health care service, 2 30 assisted or independent living service, or other 2 31 ancillary service, unless such rights of hospital 2 32 trustees generally are specifically denied by this 2 33 chapter, or unless such duties are expressly charged 2 34 by this chapter. 2 35 Sec. . Section 347.14, Code 1999, is amended by 2 36 adding the following new subsection: 2 37 NEW SUBSECTION. 16. Borrow moneys to be secured 2 38 solely by hospital revenues for the purposes of 2 39 improvement, maintenance, or replacement of the 2 40 hospital or for hospital equipment. 2 41 Sec. . Section 347.30, Code 1999, is amended to 2 42 read as follows: 2 43 347.30 NOTICE AND HEARING. 2 44 A county or city hospital shall serve notice and 2 45 hold a public hearing before selling or leasing any 2 46 real property pursuant to sections 347.28 and 347.29. 2 47 The notice shall definitely describe the property, 2 48 indicate the date and location of the hearing, and 2 49 shall be published by at least one insertion each week 2 50 for two consecutive weeks in a newspaper having 3 1 general circulation in the county where the property 3 2 is located. The hearing shall not take place prior to 3 3 two weeks after the second publication. 3 4 Sec. Section 347A.1, unnumbered paragraph 1, 3 5 Code 1999, is amended to read as follows: 3 6 A county having a population less than one hundred 3 7 fifty thousand may issue revenue bonds for a county 3 8 hospital as provided in section 331.461, subsection 2, 3 9 paragraph "e". The administration and management of 3 10 the hospital shall be vested in a board of hospital 3 11 trustees consisting of five or seven members 3 12appointed. Appointments for a five-member board shall 3 13 be made by the board of supervisors from among the 3 14 resident citizens of the county with reference to 3 15 their fitness for office, and not more than two of the 3 16 trustees shall be residents of the same township. 3 17 Expansion from a five-member to a seven-member board 3 18 of trustees shall occur only on approval of a majority 3 19 of the five-member board of trustees. The five-member 3 20 board of trustees shall appoint members to the 3 21 additional vacancies; one appointee shall serve until 3 22 the succeeding general election and the other 3 23 appointee shall serve until the second succeeding 3 24 general election at which times successors shall be 3 25 elected. 3 26 Sec. . Section 392.6, unnumbered paragraph 2, 3 27 Code 1999, is amended to read as follows: 3 28 Cities maintaining an institution as provided for 3 29 in this section which have a board of trustees 3 30 consisting of three members may by ordinance increase 3 31 the number of members to five or seven and provide for 3 32 the appointment of oneof theadditional member in the 3 33 expansion to a five-member board or two additional 3 34 members in the expansion to a seven-member board until 3 35 the next succeeding general or city election, and for 3 36 the appointment of the one or two other additional 3 37membermembers until the second succeeding general or 3 38 city election. Thereafter, the terms of office of 3 39 such additional members shall be four years. However, 3 40 if a city has adopted an ordinance which increases the 3 41 number of members of the board of trustees to five or 3 42 seven members and the terms of office of four of the 3 43 five members or six of the seven members end in the 3 44 same year, the date of expiration of the term of one 3 45 of the four members or two of the six members, to be 3 46 determined by lot, shall be extended by an additional 3 47 two years." 3 48 #3.
