PAG LIN 1 1 Section 1. Section 535.3, Code 1999, is amended to read as 1 2 follows: 1 3 535.3 INTEREST ON JUDGMENTS,ANDDECREES, AND CLAIMS. 1 4 1. Interest shall be allowed on all money due on judgments 1 5 and decrees of courts at a rate calculated according to 1 6 section 668.13, except for interest due pursuant to section 1 7 85.30 for which the rate shall be ten percent per year. 1 8 2. Interest on periodic payments for child, spousal, or 1 9 medical support shall not accrue until thirty days after the 1 10 payment becomes due and owing and shall accrue at a rate of 1 11 ten percent per annum thereafter. Additionally, interest on 1 12 these payments shall not accrue on amounts being paid through 1 13 income withholding pursuant to chapter 252D for the time these 1 14 payments are unpaid solely because the date on which the payor 1 15 of income withholds income based upon the payor's regular pay 1 16 cycle varies from the provisions of the support order. 1 17 3. Interest on a medical assistance debt due pursuant to 1 18 section 249A.5 shall accrue at a rate equal to the coupon 1 19 issue yield equivalent, as determined by the United States 1 20 secretary of the treasury, of the average accepted auction 1 21 price for the last auction of fifty-two-week United States 1 22 treasury bills settled immediately prior to the date which is 1 23 six months after the death of the medical assistance 1 24 recipient. The interest shall begin to accrue six months 1 25 after the death of the medical assistance recipient, surviving 1 26 spouse, or surviving child. 1 27 EXPLANATION 1 28 This bill specifies the means of computing the interest 1 29 rate for repayment of a medical assistance debt. 1 30 LSB 5922HC 78 1 31 pf/as/5
