PAG LIN 1 1 Section 1. Section 279.52, unnumbered paragraph 1, Code 1 2 1999, is amended to read as follows: 1 3 The board of directors may pay the actual cost of an 1 4 asbestos project from any funds in the general fund of the 1 5 district, funds received from the physical plant and equipment 1 6 levy,funds received from the additional enrichment amount for1 7an asbestos project in section 279.53,or moneys obtained 1 8 through a federal asbestos loan program, to be repaid from any 1 9 of the funds specified in this subsection over a three-year 1 10 period. 1 11 Sec. 2. Section 298.14, unnumbered paragraphs 1 and 2, 1 12 Code 1999, are amended to read as follows: 1 13 For each fiscal year, the cumulative total of the percents 1 14 of surtax approved by the board of directors of a school 1 15 district and collected by the department of revenue and 1 16 finance under sections 257.21, 257.29,279.54,and 298.2, and 1 17 the enrichment surtax under section 442.15, Code 1989, and an 1 18 income surtax collected by a political subdivision under 1 19 chapter 422D, shall not exceed twenty percent. 1 20 A school district income surtax fund is created in the 1 21 office of treasurer of state. Income surtaxes collected by 1 22 the department of revenue and finance under sections 257.21, 1 23 257.29,279.54,and 298.2 and section 442.15, Code 1989, shall 1 24 be deposited in the school district income surtax fund to the 1 25 credit of each school district. A separate accounting of each 1 26 surtax, by school district, shall be maintained. 1 27 Sec. 3. Sections 279.53 and 279.54, Code 1999, are 1 28 repealed. 1 29 EXPLANATION 1 30 This bill provides for the repeal of provisions authorizing 1 31 the raising of an additional enrichment amount to fund 1 32 asbestos removal projects. Code sections 279.53 and 279.54 1 33 currently authorize the levy of an enrichment property tax or 1 34 combination of an enrichment property tax and income surtax 1 35 for up to a five-year period to school districts involved in 2 1 projects related to asbestos removal. The bill repeals these 2 2 sections, and deletes a reference to this form of funding in 2 3 Code section 279.52. Asbestos removal projects would continue 2 4 to be able to be financed out of any funds in the general fund 2 5 of a school district, funds received from the physical plant 2 6 and equipment levy, or moneys obtained through a federal 2 7 asbestos loan program, pursuant to Code section 279.52. 2 8 LSB 6805YC 78 2 9 rn/cf/24
