  1  1    Section 1.  Section 455A.19, subsection 1, paragraph c,
  1  2 Code 1999, is amended to read as follows:
  1  3    c.  Twenty percent shall be allocated to the soil and water
  1  4 enhancement account.  The moneys shall be used to carry out
  1  5 soil and water enhancement programs including, but not limited
  1  6 to, reforestation, woodland protection and enhancement,
  1  7 wildlife habitat preservation and enhancement, protection of
  1  8 highly erodible soils, and clean water programs.  The division
  1  9 of soil conservation, by rule, shall establish procedures for
  1 10 eligibility, application, review, and selection of projects
  1 11 and practices to implement the requirements of this paragraph.
  1 12 There is appropriated from the soil and water enhancement
  1 13 account to the soil conservation division the amount in that
  1 14 account, or so much thereof as is necessary, to carry out the
  1 15 programs as specified in this paragraph.  Remaining funds of
  1 16 the soil and water conservation enhancement account shall be
  1 17 allocated to the accounts of the water protection fund
  1 18 authorized in section 161C.4.  Annually, fifty percent of the
  1 19 soil and water enhancement account funds, not to exceed one
  1 20 million dollars, shall be allocated to the water quality
  1 21 protection projects account.  The balance of the funds shall
  1 22 be allocated to the water protection practices account.  An
  1 23 appropriation made under this paragraph shall continue in
  1 24 force for two fiscal years after the fiscal year in which the
  1 25 appropriation was made or until completion of the project for
  1 26 which the appropriation was made, whichever date is earlier.
  1 27 All unencumbered or unobligated funds remaining at the close
  1 28 of the fiscal year in which the project is completed or at the
  1 29 close of the third fiscal year, whichever date is earlier,
  1 30 shall revert to the soil and water enhancement account.  
  1 31                           EXPLANATION
  1 32    This bill removes the $1,000,000 maximum allocation of
  1 33 funds to the water quality protection projects account and
  1 34 provides that 50 percent of the moneys allocated to the soil
  1 35 and water enhancement account of the resource enhancement and
  2  1 protection fund will be divided equally between the water
  2  2 quality projects account and water quality protection
  2  3 practices account within the division of soil conservation of
  2  4 the department of agriculture and land stewardship.
