  1  1    Section 1.  Section 6B.2A, Code Supplement 1999, is amended
  1  2 by adding the following new subsection:
  1  3    NEW SUBSECTION.  4.  This section shall not apply to a
  1  4 condemnation of property by the state department of
  1  5 transportation for right-of-way that is contiguous to an
  1  6 existing road right-of-way and necessary for the maintenance,
  1  7 safety improvement, or repair of the existing road.
  1  8    Sec. 2.  Section 6B.2B, subsection 2, Code Supplement 1999,
  1  9 is amended to read as follows:
  1 10    2.  The acquiring agency shall provide the owner of record
  1 11 of the private property with a statement of their individual
  1 12 rights to be included with the notice required under section
  1 13 6B.2A.  The attorney general shall adopt rules pursuant to
  1 14 chapter 17A prescribing a statement of rights which may be
  1 15 used in substantial form by any person required to provide the
  1 16 statement by this section.  This subsection shall not apply to
  1 17 a condemnation of property by the state department of
  1 18 transportation for right-of-way that is contiguous to an
  1 19 existing road right-of-way and necessary for the maintenance,
  1 20 safety improvement, or repair of the existing road.
  1 21    Sec. 3.  Section 327J.1, Code 1999, is amended by adding
  1 22 the following new subsection:
  1 23    NEW SUBSECTION.  5.  "Midwest regional rail system" means
  1 24 the passenger rail system identified through a multistate
  1 25 planning effort in cooperation with AMTRAK.
  1 26    Sec. 4.  Section 327J.3, subsections 2 through 4, Code
  1 27 1999, are amended by striking the subsections and inserting in
  1 28 lieu thereof the following:
  1 29    2.  The director may enter into agreements with AMTRAK and
  1 30 other states associated with the midwest regional rail system
  1 31 for the purpose of developing a rail passenger system serving
  1 32 the midwest, including service from Chicago, Illinois, to
  1 33 Omaha, Nebraska, through Iowa.  The agreements may include any
  1 34 of the following:
  1 35    a.  Cost-sharing agreements associated with initiating
  2  1 service, capital costs, operating subsidies, and other costs
  2  2 necessary to develop and maintain service.
  2  3    b.  Joint powers agreements and other institutional
  2  4 arrangements associated with the administration, management,
  2  5 and operation of a midwest regional rail system.
  2  6    3.  The director shall enter into discussions with members
  2  7 of Iowa's congressional delegation to foster rail passenger
  2  8 service in this state and the midwest and to maximize the
  2  9 level of federal funding for the service, including funding
  2 10 for the midwest regional rail system.
  2 11    4.  The director may provide assistance and enter into
  2 12 agreements with cities along the proposed route of the midwest
  2 13 regional rail system or other passenger rail system serving
  2 14 the midwest to ensure that rail stations and terminals are
  2 15 designed and developed in accordance with the following
  2 16 objectives:
  2 17    a.  To meet safety and efficiency requirements outlined by
  2 18 AMTRAK and the federal railroad administration.
  2 19    b.  To aid intermodal transportation.
  2 20    c.  To encourage economic development.
  2 21    5.  The director shall report annually to the general
  2 22 assembly concerning the development and operation of the
  2 23 midwest regional rail system and the state's passenger rail
  2 24 service.
  2 25    Sec. 5.  Section 328.35, subsection 1, Code 1999, is
  2 26 amended by adding the following new paragraph:
  2 27    NEW PARAGRAPH.  e.  An aircraft which is displayed in a
  2 28 museum.
  2 29    Sec. 6.  Section 543D.3, unnumbered paragraph 2, Code
  2 30 Supplement 1999, is amended to read as follows:
  2 31    A person who is not a certified real estate appraiser under
  2 32 this chapter may appraise real estate for compensation if
  2 33 certification is not required by this chapter or by federal or
  2 34 state law, rule, or policy.  However, an employee of the state
  2 35 department of transportation whose duties include appraisals
  3  1 of property pursuant to chapter 6B must be a certified or an
  3  2 associate real estate appraiser under this chapter.  An
  3  3 associate real estate appraiser employed by the state
  3  4 department of transportation who appraises property pursuant
  3  5 to chapter 6B shall be directly supervised by a supervising
  3  6 appraiser who is certified in good standing.
  3  7    Sec. 7.  EFFECTIVE DATE.  Sections 1 and 2 of this Act,
  3  8 being deemed of immediate importance, take effect upon
  3  9 enactment.  
  3 10                           EXPLANATION
  3 11    This bill makes several Code changes relating to modal
  3 12 transportation and highway projects.
  3 13    The bill amends Code sections 6B.2A and 6B.2B, which
  3 14 require agencies acquiring property for public improvements by
  3 15 condemnation to provide to the owner of the property notice of
  3 16 the proposed public improvement and possible condemnation and
  3 17 a statement of rights, to provide that such requirements do
  3 18 not apply to condemnations of property by the state department
  3 19 of transportation for right-of-way that is contiguous to an
  3 20 existing road right-of-way and necessary for the maintenance,
  3 21 safety improvement, or repair of the existing road.  The bill
  3 22 provides that these changes shall be effective upon the bill's
  3 23 enactment.
  3 24    The bill also defines "midwest regional rail system" as the
  3 25 passenger rail system identified through a multistate planning
  3 26 effort in cooperation with AMTRAK, for purposes of Code
  3 27 chapter 327J, relating to passenger rail service.
  3 28    Code section 327J.3, relating to administration by the
  3 29 director of transportation of the passenger rail service
  3 30 revolving fund and of activities related to passenger rail
  3 31 service, is amended to allow the director to enter into
  3 32 agreements with AMTRAK and the other states associated with
  3 33 the midwest regional rail system to develop a rail passenger
  3 34 system serving the midwest, including service from Chicago to
  3 35 Omaha through Iowa.  The agreements may include cost-sharing
  4  1 arrangements for costs associated with initiating service and
  4  2 other necessary costs and joint powers agreements and other
  4  3 institutional arrangements associated with the administration,
  4  4 management, and operation of a midwest regional rail system.
  4  5 The section is also amended to require the director to enter
  4  6 into discussions with Iowa's congressional delegation to
  4  7 foster rail passenger service in Iowa and the midwest and to
  4  8 maximize federal funding for such service.  The director is
  4  9 permitted to provide assistance and enter into agreements with
  4 10 cities on the route of the midwest regional rail system to
  4 11 ensure that rail stations and terminals are designed and
  4 12 developed in accordance with certain objectives.  The bill
  4 13 also requires the director of transportation to report
  4 14 annually to the general assembly concerning the development
  4 15 and operation of the midwest regional rail system and the
  4 16 state's rail passenger service.
  4 17    Currently, Code section 327J.3 requires the director of
  4 18 transportation to enter into various discussions with the
  4 19 states of Illinois and Nebraska, AMTRAK, and Iowa's
  4 20 congressional delegation for the purpose of securing AMTRAK
  4 21 passenger service from Chicago to Omaha using the Chicago and
  4 22 northwestern transportation company railroad tracks.  The Code
  4 23 section also currently allows the director to provide
  4 24 technical assistance to cities along the proposed AMTRAK route
  4 25 to ensure that passenger facilities meeting AMTRAK
  4 26 requirements are available in a timely manner and requires the
  4 27 director to report regularly to the general assembly
  4 28 concerning the progress of efforts to secure central Iowa
  4 29 AMTRAK passenger service.
  4 30    The bill also amends Code section 328.35 to exempt aircraft
  4 31 displayed in museums from the aircraft registration and
  4 32 registration fee requirements in Code chapter 328.
  4 33    Additionally, the bill amends a provision in Code section
  4 34 543D.3 currently requiring an employee of the state department
  4 35 of transportation whose duties include appraisals of property
  5  1 condemned pursuant to eminent domain to be a certified real
  5  2 estate appraiser under Code chapter 543D, to allow such
  5  3 employee to be an associate real estate appraiser if the
  5  4 employee is directly supervised by a supervising appraiser who
  5  5 is certified in good standing.
