PAG LIN 1 1 Section 1. Section 321.24, unnumbered paragraph 9, Code 1 2 Supplement 1999, is amended to read as follows: 1 3 A vehicle shall be registered for the registration year. A 1 4 vehicle registered for the first time in this state shall be 1 5 registered for the remaining unexpired months of the 1 6 registration year and pay a registration fee prorated for the 1 7 remaining unexpired months of the registration year. A 1 8 vehicle registered for the first time during the eleventh 1 9 month of the owner's registration year may be registered for 1 10 the remaining unexpired months of the registration year as 1 11 provided in this paragraph or for the remaining unexpired 1 12 months of the registration year and for the next registration 1 13 year, upon payment of the applicable registration fees. 1 14 Sec. 2. Section 321.40, unnumbered paragraphs 1 and 2, 1 15 Code 1999, are amended to read as follows: 1 16 Application for renewal of a vehicle registration shall be 1 17 made on or after the first day of the month prior to the month 1 18 of expiration of registration and up to and including the last 1 19 day of the month following the month of expiration of 1 20 registration. The registration shall be renewed upon payment 1 21 of the appropriate registration fee. 1 22 On or before the fifteenth day of the eleventh monthof1 23expirationof a vehicle's registration year the county 1 24 treasurer shall send a statement by mail of fees due to the 1 25 appropriate owner of record. The statement shall be mailed to 1 26 the most current address of record, showing information 1 27 sufficient to identify the vehicle and a listing of the 1 28 various fees as appropriate. Failure to receive a statement 1 29 shall have no effect upon the accrual of penalty at the 1 30 appropriate date. 1 31 Sec. 3. Section 321.106, Code 1999, is amended to read as 1 32 follows: 1 33 321.106 REGISTRATION FOR FRACTIONAL PART OF YEAR. 1 34 1. When a vehicle is registered under chapter 326 or a 1 35 motor truck, truck tractor, or road tractor is registered for 2 1 a combined gross weight exceeding five tons and there is no 2 2 delinquency and the registration is made in February or 2 3 succeeding months throughNovemberOctober, the registration 2 4 fee shall be prorated for the remaining unexpired months of 2 5 the registration year. When such a vehicle is registered in 2 6 November, the vehicle may be registered for the remaining 2 7 unexpired months of the registration year or for the remaining 2 8 unexpired months of the registration year and for the next 2 9 registration year, upon payment of the applicable registration 2 10 fees. A fee shall not be required for the month of December 2 11 for a vehicle registered on a calendar year basis on which 2 12 there is no delinquency. 2 13 2. When a vehicle is registered on a birth month basis and 2 14 there is no delinquency and the registration is made in the 2 15 month after the beginning of the registration yearor2 16succeeding monthsthrough the tenth month of the registration 2 17 year the registration fee shall be prorated for the remaining 2 18 unexpired months of the registration year. When a vehicle 2 19 registered on a birth month basis is registered during the 2 20 eleventh month of the registration year, the vehicle may be 2 21 registered for the remaining unexpired months of the 2 22 registration year or for the remaining unexpired months of the 2 23 registration year and for the next registration year, upon 2 24 payment of the applicable registration fees. A fee shall not 2 25 be required for the month of the owner's birthday for a 2 26 vehicle on which there is no delinquency. 2 27 3. If a fee computed under this section contains a 2 28 fractional part of a dollar, the fee shall be computed to the 2 29 nearest whole dollar. A fee computed under this section shall 2 30 not be less than five dollars. The fee so computed shall be 2 31 deemed to be the annual registration fee for the remainder of 2 32 the registration year. 2 33 4. A reduction in the registration fee shall not be 2 34 allowed by the department until the applicant files 2 35 satisfactory evidence to prove that there is no delinquency in 3 1 registration. 3 2 Sec. 4. EFFECTIVE DATE. This Act takes effect January 1, 3 3 2001. 3 4 EXPLANATION 3 5 This bill amends several Code provisions relating to the 3 6 registration of vehicles to allow a three-month period for 3 7 renewal of a vehicle registration and to allow persons 3 8 registering a vehicle for the first time in the eleventh month 3 9 of what will be the person's registration year to register the 3 10 vehicle for the remaining eleventh and twelfth months of what 3 11 will be the person's registration year or for that eleventh 3 12 and twelfth months and for the following registration year, 3 13 upon payment of the applicable prorated registration fee and 3 14 full-year registration fee. 3 15 The bill takes effect January 1, 2001. 3 16 LSB 5983YC 78 3 17 nh/cf/24
