1 1 Section 1. Section 85.34, subsection 2, Code 1999, is
1 2 amended by adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. If an injury results in a
1 4 disability which is attributable in part to a preexisting
1 5 disability, from whatever cause, whether or not compensable
1 6 under this chapter or chapter 85A, 85B, or 86, the
1 7 compensation payable for the permanent partial disability
1 8 pursuant to this section shall be reduced by the proportion of
1 9 the disability which is attributable only to the preexisting
1 10 disability.
1 11 EXPLANATION
1 12 This bill provides that in determining the liability of an
1 13 employer for an injury resulting in a permanent partial
1 14 disability, any preexisting disability the employee had before
1 15 the injury, regardless of whether or not it was work related,
1 16 will be apportioned out of the total disability found to exist
1 17 after the injury.
