1 1 Section 1. Section 9H.4, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 4A. Agricultural land acquired by a
1 4 corporation or limited liability company for the primary
1 5 purpose of raising livestock to produce a laboratory product,
1 6 if all of the following apply:
1 7 a. The laboratory product must be one of the following:
1 8 (1) Embryos or oocytes for use in implantation.
1 9 (2) Blood, milk, or urine for use in the manufacture of
1 10 pharmaceuticals or nutriceuticals.
1 11 (3) Cells, tissue, or organs for use in transplantation.
1 12 b. The corporation or limited liability company must not
1 13 hold a total of more than one thousand five hundred acres of
1 14 agricultural land for use in producing laboratory products as
1 15 provided in this subsection. The corporation or limited
1 16 liability company may hold an ownership or leasehold interest
1 17 in the agricultural land.
1 18 c. The commercial sales of products produced from the
1 19 agricultural land must be limited to any of the following:
1 20 (1) The sale of a laboratory product as provided in this
1 21 subsection.
1 22 (2) Incidental sales of livestock, including culls, which
1 23 are raised for purposes of producing a laboratory product.
1 24 Sec. 2. NEW SECTION. 9H.7 PRODUCERS OF LABORATORY
1 25 PRODUCTS REPORTS.
1 26 1. As used in this section, "reporting entity" means a
1 27 corporation or limited liability company which holds
1 28 agricultural land under section 9H.4, subsection 4A, for the
1 29 primary purpose of raising livestock to produce a laboratory
1 30 product.
1 31 2. The reporting entity shall file a report with the
1 32 secretary of state on or before March 31 of each year on forms
1 33 adopted pursuant to chapter 17A and supplied by the secretary
1 34 of state. The report shall contain the following information
1 35 for the last year:
2 1 a. The name and principal place of business of the
2 2 reporting entity.
2 3 b. The location of the agricultural land used for the
2 4 raising of livestock.
2 5 c. The number of acres of agricultural land held by the
2 6 reporting entity.
2 7 d. The total amount of commercial sales of laboratory
2 8 products and incidental sales associated with raising the
2 9 livestock.
2 10 EXPLANATION
2 11 This bill amends Code section 9H.4 which prohibits
2 12 corporate entities from holding agricultural land, including
2 13 by ownership or leasehold. A corporate entity which violates
2 14 the provision is subject to a civil penalty of $25,000 and
2 15 must divest itself of the land held in violation of the Code
2 16 section. The Code section provides a number of exceptions to
2 17 the prohibition. The bill adds a new exception by providing
2 18 that agricultural land may be acquired by a corporate entity
2 19 (in this case a corporation or limited liability company) for
2 20 raising livestock for the primary purpose of producing and
2 21 marketing a laboratory product which includes embryos or
2 22 oocytes for use in implantation; blood, milk, or urine for use
2 23 in manufacturing pharmaceuticals or nutriceuticals; or cells,
2 24 tissue, or organs for use in transplantation. The corporate
2 25 entity cannot hold more than 1,500 acres of agricultural land.
2 26 The bill provides that commercial sales of products produced
2 27 from the land must be limited to laboratory products and
2 28 incidental sales from the sale of livestock.
2 29 The bill requires the corporate entity to file a report
2 30 with the secretary of state each year describing the entity
2 31 and its business. A person who fails to file an accurate and
2 32 timely report is subject to a civil penalty of up to $1,000.
