  1  1    Section 1.  Section 516A.1, Code 1999, is amended to read
  1  2 as follows:
  1  3    516A.1  COVERAGE INCLUDED IN EVERY LIABILITY POLICY –
  1  4 REJECTION BY INSURED.
  1  5    1.  a.  No An automobile liability or motor vehicle
  1  6 liability insurance policy insuring against liability for
  1  7 bodily injury or death arising out of the ownership,
  1  8 maintenance, or use of a motor vehicle shall not be delivered
  1  9 or issued for delivery in this state with respect to any motor
  1 10 vehicle registered or principally garaged in this state,
  1 11 unless coverage is provided in such the policy or a
  1 12 supplemental thereto, for the protection of persons insured
  1 13 under such the policy who are legally entitled to recover
  1 14 damages from the owner or operator of an uninsured motor
  1 15 vehicle or a hit-and-run motor vehicle or an underinsured
  1 16 motor vehicle because of bodily injury, sickness, or disease,
  1 17 including a resulting death resulting therefrom, caused by
  1 18 accident and arising out of the ownership, maintenance, or use
  1 19 of such uninsured or underinsured motor vehicle, or arising
  1 20 out of physical contact of such the hit-and-run motor vehicle
  1 21 with the person insured or with a motor vehicle which the
  1 22 person insured is occupying at the time of the accident.
  1 23    b.  Both the uninsured motor vehicle or hit-and-run motor
  1 24 vehicle coverage, and the underinsured motor vehicle coverage
  1 25 shall include limits for bodily injury or death at least equal
  1 26 to those stated in section 321A.1, subsection 10.
  1 27    c.  The form and provisions of such coverage shall be
  1 28 examined and approved by the commissioner of insurance.
  1 29    2.  a.  However, the The named insured may reject all of
  1 30 such coverage required under subsection 1, or reject the
  1 31 uninsured motor vehicle (hit-and-run motor vehicle) coverage,
  1 32 or reject the underinsured motor vehicle coverage, by written
  1 33 rejections signed by the named insured.  If rejection is made
  1 34 on a form or document furnished by an insurance company or
  1 35 insurance agent, it shall be on a separate sheet of paper
  2  1 document which contains only the rejection and information
  2  2 directly related to it.  The named insured may, but shall not
  2  3 be required to, consent to receive such document either on
  2  4 paper or electronically.  The named insured may also reject
  2  5 coverage pursuant to this subsection by either written or
  2  6 electronic means.  This paragraph shall not be construed to
  2  7 require any party to use or accept electronic documents or
  2  8 electronic signatures.
  2  9    b.  Such coverage Coverage required under subsection 1 need
  2 10 not be provided in or supplemental to a renewal policy if the
  2 11 named insured has rejected the coverage in connection with a
  2 12 policy previously issued to the named insured by the same
  2 13 insurer.  
  2 14                           EXPLANATION
  2 15    This bill amends Code section 516A.1 relating to insurance
  2 16 coverage against uninsured, underinsured, or hit-and-run
  2 17 motorists.  The bill permits parties to the insurance contract
  2 18 to transmit any rejections of such coverage electronically,
  2 19 but specifies that a party to the contract is not required to
  2 20 use or accept electronic documents or electronic signatures.
  2 21    The bill also makes some technical changes and divides the
  2 22 current section into subsections and paragraphs.
