PAG LIN 1 1 Section 1. Section 321G.6, unnumbered paragraph 6, Code 1 2 Supplement 1999, is amended to read as follows: 1 3 Upon the transfer of ownership of an all-terrain vehicle or 1 4 snowmobile, the owner shall complete the form on the back ofa1 5 the current registration certificate and shall deliver it to 1 6 the purchaser or transferee at the time of delivering the all- 1 7 terrain vehicle or snowmobile.If an all-terrain vehicle or1 8snowmobile is stored by the transferor pursuant to section1 9321G.4 at the time of transfer, the transferor shall provide1 10the transferee with a copy of the affidavit filed with the1 11county recorder pursuant to section 321G.4 at the time of1 12delivering the all-terrain vehicle or snowmobile.The 1 13 purchaser or transferee shall, within five days of transfer, 1 14 file a new application form with the county recorder with a 1 15 fee of one dollar and the writing fee, and a transfer of 1 16 number shall be awarded in the same manner as provided in an 1 17 original registration. If the purchaser or transferee does 1 18 not file a new application form within five days of transfer, 1 19 the transfer of number shall be awarded upon payment of all 1 20 applicable fees plus a penalty of five dollars. 1 21 Sec. 2. Section 321G.27, Code 1999, is amended to read as 1 22 follows: 1 23 321G.27 WRITING FEES. 1 24 The county recorder shall collect a writing fee ofone1 25dollartwo dollars for an all-terrain vehicle or snowmobile 1 26 registration. 1 27 Sec. 3. Section 462A.5, subsection 1, unnumbered paragraph 1 28 2, Code 1999, is amended to read as follows: 1 29 The owner of the vessel shall file an application for 1 30 registration with the appropriate county recorder on forms 1 31 provided by the commission. The application shall be 1 32 completed and signed by the owner of the vessel and shall be 1 33 accompanied by the appropriate fee, andathe writing feeof1 34one dollarspecified in section 462A.53. Upon applying for 1 35 registration the owner shall display a bill of sale, receipt, 2 1 or other satisfactory proof of ownership as provided by the 2 2 rules of the commission to the county recorder. Upon receipt 2 3 of the application in approved form accompanied by the 2 4 required fees, the county recorder shall enter it upon the 2 5 records of the recorder's office and shall issue to the 2 6 applicant a pocket-size registration certificate. The 2 7 certificate shall be executed in triplicate, one copy to be 2 8 delivered to the owner, one copy to the commission, and one 2 9 copy to be retained on file by the county recorder. The 2 10 registration certificate shall bear the number awarded to the 2 11 vessel, the passenger capacity of the vessel and the name and 2 12 address of the owner. In the use of all vessels except 2 13 nonpowered sailboats, nonpowered canoes and commercial 2 14 vessels, the registration certificate shall be carried either 2 15 in the vessel or on the person of the operator of the vessel 2 16 when in use. In the use of nonpowered sailboats, nonpowered 2 17 canoes or commercial vessels, the registration certificate may 2 18 be kept on shore in accordance with rules adopted by the 2 19 commission. The operator shall exhibit the certificate to a 2 20 peace officer upon request, or, when involved in a collision 2 21 or accident of any nature with another vessel or other 2 22 personal property, to the owner or operator of the other 2 23 vessel or personal property. 2 24 Sec. 4. Section 462A.53, Code 1999, is amended to read as 2 25 follows: 2 26 462A.53 AMOUNT OF WRITING FEES. 2 27 A writing fee ofone dollartwo dollars for each 2 28 transaction shall be collected by the county recorder. If two 2 29 or more functions are transacted for the same vessel at one 2 30 time, the writing fee is limited toone dollartwo dollars. 2 31 Sec. 5. Section 483A.10, Code 1999, is amended to read as 2 32 follows: 2 33 483A.10 ISSUANCE OF LICENSES. 2 34 The licenses issued pursuant to this chapter shall be 2 35 issued by the department, the county recorders,or the license 3 1 depositaries as specified by rules of the commission. A 3 2 county recorder may issue licenses subject to the rules of the 3 3 department. The rules shall include the application 3 4 procedures as necessary. The licenses shall show the cost of 3 5 the license and the writing fee. A person authorized to issue 3 6 a license or collect a fee pursuant to this chapter or chapter 3 7 484A shall charge the fee specified in this chapter or chapter 3 8 484A only plus a writing fee if applicable. 3 9 EXPLANATION 3 10 This bill strikes a requirement that if an all-terrain 3 11 vehicle or snowmobile is stored at the time of transfer, the 3 12 transferor shall provide the transferee with a copy of the 3 13 affidavit filed with the county recorder at the time of 3 14 delivering the all-terrain vehicle or snowmobile. 3 15 The bill also increases the writing fee for all-terrain 3 16 vehicle, snowmobile, or boat registration activities from $1 3 17 to $2. 3 18 The bill also gives county recorders the option of selling 3 19 hunting, fishing, fur-harvesting, and related licenses and 3 20 permits for the department of natural resources. 3 21 LSB 5762HC 78 3 22 tj/as/5
