PAG LIN 1 1 Section 1. Section 123.187, subsection 2, Code 1999, is 1 2 amended to read as follows: 1 3 2. A winery licensed or permitted pursuant to laws 1 4 regulating alcoholic beverages in a state which affords this 1 5 state an equal reciprocal shipping privilege may ship into 1 6 this state by private common carrier, to a person twenty-one 1 7 years of age or older, not more than eighteen liters of wine 1 8 per month, for consumption or use by the person. Such wine 1 9 shall not be resold. Shipment of wine pursuant to this 1 10 subsection is not subject to sales tax under section 422.43, 1 11 use tax under section 423.2, or the wine gallonage tax under 1 12 section 123.183, and does not require a refund value for1 13beverage container control purposes under chapter 455C. 1 14 Sec. 2. Section 455C.1, subsection 1, Code 1999, is 1 15 amended to read as follows: 1 16 1. "Beverage" meanswine as defined in section 123.3,1 17subsection 37,alcoholic liquor as defined in section 123.3, 1 18 subsection 5, beer as defined in section 123.3, subsection 7, 1 19 mineral water, soda water, and similar carbonated soft drinks 1 20 in liquid form and intended for human consumption. 1 21 Sec. 3. Section 455C.4, subsection 3, Code 1999, is 1 22 amended to read as follows: 1 23 3. A dealer or a distributor may refuse to accept and to 1 24 pay the refund value of an emptywine oralcoholic liquor 1 25 container which is marked to indicate that it was sold by a 1 26 state liquor store. The alcoholic beverages division shall 1 27 not reimburse a dealer or a distributor the refund value on an 1 28 emptywine oralcoholic liquor container which is marked to 1 29 indicate that the container was sold by a state liquor store. 1 30 Sec. 4. Section 455D.4, Code 1999, is amended by adding 1 31 the following new subsection: 1 32 NEW SUBSECTION. 6. It is the policy of this state to 1 33 encourage unified, comprehensive waste collection and 1 34 recycling programs by encouraging the development of curbside 1 35 recycling programs for collection of household waste. 2 1 Sec. 5. DEPARTMENT OF NATURAL RESOURCES. The department 2 2 may use landfill alternative financial assistance moneys under 2 3 section 455E.11 to provide incentives with the goal of 2 4 locating an end manufacturer or processor for crushed recycled 2 5 glass in a central location within the state. 2 6 EXPLANATION 2 7 The bill removes wine from the definition of beverages in 2 8 Code section 455C.1 so that containers containing wine are no 2 9 longer subject to the five cent mandatory beverage container 2 10 deposit. 2 11 The bill allows the department of natural resources to use 2 12 landfill alternative financial assistance moneys to provide 2 13 incentives with the goal of locating an end manufacturer or 2 14 processor for crushed recycled glass in a central Iowa 2 15 location. Landfill alternative financial assistance moneys 2 16 are allocated to the department from the solid waste account 2 17 of the groundwater protection fund under Code section 455E.11 2 18 and are used to encourage alternatives to landfilling. 2 19 The bill establishes in Code section 455D.4 as a public 2 20 policy of the state the encouragement of curbside recycling 2 21 programs. 2 22 The bill also makes conforming amendments to Code sections 2 23 123.187 and 455C.4. 2 24 LSB 3133HC 78 2 25 tm/cf/24.1
