PAG LIN 1 1 Section 1. Section 903.1, subsection 1, paragraph a, Code 1 2 1999, is amended to read as follows: 1 3 a. For a simple misdemeanor, either imprisonment not to 1 4 exceed thirty days, or a fine of at least fifty dollars but 1 5 not to exceedonetwo hundred dollars. 1 6 Sec. 2. Section 903.1, subsection 3, Code 1999, is amended 1 7 to read as follows: 1 8 3. A person under eighteen years of age convicted of a 1 9 simple misdemeanor under chapter 321, 321G, 453A, 461A, 461B, 1 10 462A, 481A, 481B, 483A, 484A, or 484B, or a violation of a 1 11 county or municipal curfew or traffic ordinance, except for an 1 12 offense subject to section 805.8, may be required to pay a 1 13 fine, not to exceedonetwo hundred dollars, as fixed by the 1 14 court, or may be required to perform community service as 1 15 ordered by the court. 1 16 EXPLANATION 1 17 This bill changes the maximum fine amount for a simple 1 18 misdemeanor, if a specific fine is not otherwise provided for 1 19 in statute, to $200. Under current law, a simple misdemeanor 1 20 is punishable by a fine not to exceed $100 or imprisonment not 1 21 to exceed 30 days, but not both, unless a different and 1 22 specific penalty is otherwise provided. 1 23 The bill makes a similar change in the fine for a minor 1 24 convicted of certain state or local traffic or game and 1 25 wildlife offenses. 1 26 LSB 1782XL 78 1 27 jm/cf/24.1
