  1  1    Section 1.  Section 22.7, subsection 10, Code 1999, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 22.7, subsection 11, Code 1999, is amended
  1  4 to read as follows:
  1  5    11.  Personal information in confidential personnel and
  1  6 payroll records of public bodies including but not limited to
  1  7 cities, boards of supervisors and school districts government
  1  8 bodies which pertain to individuals who are officials,
  1  9 officers, or employees of the government bodies.  However, the
  1 10 following information pertaining to an individual who is an
  1 11 official, officer, or employee of a government body which may
  1 12 be contained in confidential personnel and payroll records
  1 13 shall not be confidential:
  1 14    a.  The name and compensation paid to the individual.
  1 15    b.  The date the individual was employed by the government
  1 16 body.
  1 17    c.  The positions the individual holds or has held with the
  1 18 government body.
  1 19    d.  The individual's qualifications for the position that
  1 20 the individual holds or has held, including, but not limited
  1 21 to, educational background and work experience.
  1 22    e.  Any disciplinary action taken against the individual
  1 23 which resulted in the individual's discharge, suspension,
  1 24 demotion, or loss of pay.
  1 25    f.  Other information for which the legal custodian of the
  1 26 information makes a determination that the public's interest
  1 27 in access outweighs the individual's interest in
  1 28 confidentiality.  
  1 29                           EXPLANATION
  1 30    This bill alters the confidentiality provisions in the
  1 31 public records chapter for personnel and payroll records
  1 32 pertaining to officials, officers, and employees of government
  1 33 bodies.  The confidentiality provision pertaining to personal
  1 34 information in confidential records of the military division
  1 35 of the department of public defense is stricken in the bill.
  2  1 The confidentiality provision pertaining to personnel records
  2  2 of other public bodies is expanded to include both personnel
  2  3 and payroll records pertaining to officials, officers, and
  2  4 employees of government bodies, but certain specific
  2  5 information within those confidential records is designated as
  2  6 nonconfidential.
  2  7    The information designated as nonconfidential includes the
  2  8 name and compensation paid to the person to whom the record
  2  9 pertains; the date of employment; positions held; the
  2 10 individual's qualifications; any disciplinary action taken
  2 11 which resulted in the individual's discharge, suspension,
  2 12 demotion, or loss of pay; and any other information for which
  2 13 the legal custodian of the information determines that the
  2 14 public's interest in access outweighs the individual's
  2 15 interest in confidentiality.
  2 16    The bill may include a state mandate as defined in Code
  2 17 section 25B.3.
