PAG LIN 1 1 Section 1. Section 144.36, subsection 4, Code 1999, is 1 2 amended to read as follows: 1 3 4. The county registrar shall record and forward to the 1 4 state registrar on or before the tenth day of each calendar 1 5 month the original certificates of marriages filed with the 1 6 county registrar during the preceding calendar monthand the1 7fees. The county registrar shall also forward to the state 1 8 registrar on or before the tenth day of each calendar month 1 9 thirty dollars of each fee collected by the county registrar 1 10 on behalf of the state for applications for a license to marry 1 11 in accordance with section 331.605, subsection76. Ten 1 12 dollars of each fee collected shall be retained by the county 1 13 and deposited in the general fund of the county. 1 14 Sec. 2. Section 331.605, subsection 6, Code 1999, is 1 15 amended to read as follows: 1 16 6. For filing an application for the license to marry, 1 17thirtyforty dollars. For issuing an application for an order 1 18 of the district court authorizing the validation of a license 1 19 to marry before the expiration of three days from the date of 1 20 issuance of the license, five dollars. The district court 1 21 shall authorize the early validation of a marriage license 1 22 without the payment of any fees imposed in this subsection 1 23 upon showing that the applicant is unable to pay the fees. 1 24 EXPLANATION 1 25 This bill increases the fee collected by the county 1 26 registrar for a license to marry from $30 to $40. Currently, 1 27 the entire $30 application fee for a marriage license is 1 28 forwarded to the state registrar for deposit in the general 1 29 fund of the state. The bill provides that $30 of each fee is 1 30 still forwarded to the state registrar, but the additional $10 1 31 of the increased fee is retained by the county for deposit in 1 32 the general fund of the county. 1 33 LSB 1755HC 78 1 34 pf/jw/5
