PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 1. Section 3 of Article III of the Constitution of the 1 4 State of Iowa is repealed and the following adopted in lieu 1 5 thereof: 1 6 REPRESENTATIVES. Sec. 3. The members of the House of 1 7 Representatives shall be chosen every second year, by the 1 8 qualified electors of their respective districts, and their 1 9 term of office shall commence on the first day of January next 1 10 after their election, and continue two years, and until their 1 11 successors are elected and qualified. A person shall not be 1 12 elected as a Representative more than six times. If a person 1 13 is elected to serve a portion of a term to which some other 1 14 person was elected, the partial term served shall not be 1 15 included as an election. 1 16 This limitation on the number of terms shall apply to terms 1 17 of office beginning on or after January 1, 2003. 1 18 2. Section 5 of Article III of the Constitution of the 1 19 State of Iowa is repealed and the following adopted in lieu 1 20 thereof: 1 21 SENATORS QUALIFICATIONS. Sec. 5. Senators shall be 1 22 chosen for the term of four years, at the same time and place 1 23 as Representatives; they shall be twenty-five years of age, 1 24 and possess the qualifications of Representatives as to 1 25 residence and citizenship. A person shall not be elected as a 1 26 Senator more than three times. If a person is elected to 1 27 serve a portion of a term to which some other person was 1 28 elected, the partial term served shall not be included as an 1 29 election. 1 30 This limitation on the number of terms shall apply to terms 1 31 of office beginning on or after January 1, 2003. 1 32 3. Section 2 of Article IV of the Constitution of the 1 33 State of Iowa, as amended by amendment number 1 of the 1 34 Amendments of 1972 and amendment number 1 of the Amendments of 1 35 1988, is repealed and the following adopted in lieu thereof: 2 1 ELECTION AND TERM. Sec. 2. The Governor and the 2 2 Lieutenant Governor shall be elected by the qualified electors 2 3 at the time and place of voting for members of the General 2 4 Assembly. Each of them shall hold office for four years from 2 5 the time of installation in office and until a successor is 2 6 elected and qualifies. A person shall not be elected Governor 2 7 or Lieutenant Governor more than three times. If a person 2 8 succeeds to the office of Governor to serve a portion of a 2 9 term to which some other person was elected Governor, the 2 10 partial term shall not be included as an election. If a 2 11 person is elected or appointed to serve as Lieutenant Governor 2 12 for a portion of a term to which some other person was elected 2 13 or appointed Lieutenant Governor, the partial term shall not 2 14 be included as an election. 2 15 This limitation on the number of terms shall apply to terms 2 16 of office beginning on or after January 1, 2003. 2 17 4. Section 22 of Article IV of the Constitution of the 2 18 State of Iowa, as amended by amendment number 1 of the 2 19 Amendments of 1972, is repealed and the following adopted in 2 20 lieu thereof: 2 21 SECRETARY AUDITOR TREASURER. Sec. 22. A Secretary 2 22 of State, an Auditor of State and a Treasurer of State shall 2 23 be elected by the qualified electors at the same time that the 2 24 Governor is elected and for a four-year term commencing on the 2 25 first day of January next after their election, and they shall 2 26 perform such duties as may be provided by law. A person shall 2 27 not be elected Secretary of State more than three times. A 2 28 person shall not be elected Auditor of State more than three 2 29 times. A person shall not be elected Treasurer of State more 2 30 than three times. If a person is elected or appointed to 2 31 serve a portion of a term to which some other person was 2 32 elected or appointed, the partial term shall not be included 2 33 as an election. 2 34 This limitation on the number of terms shall apply to terms 2 35 of office beginning on or after January 1, 2003. 3 1 5. Section 12 of Article V of the Constitution of the 3 2 State of Iowa, as amended by amendment number 1 of the 3 3 Amendments of 1972, is repealed and the following adopted in 3 4 lieu thereof: 3 5 ATTORNEY GENERAL. Sec. 12. The General Assembly shall 3 6 provide, by law, for the election of an Attorney General by 3 7 the people, whose term of office shall be four years, and 3 8 until a successor is elected and qualifies. A person shall 3 9 not be elected Attorney General more than three times. If a 3 10 person is elected or appointed to serve a portion of a term to 3 11 which some other person was elected or appointed, the partial 3 12 term shall not be included as an election. 3 13 This limitation on the number of terms shall apply to terms 3 14 of office beginning on or after January 1, 2003. 3 15 Sec. 2. The foregoing amendment to the Constitution of the 3 16 State of Iowa is referred to the General Assembly to be chosen 3 17 at the next general election for members of the General 3 18 Assembly and the Secretary of State is directed to cause the 3 19 same to be published for three consecutive months previous to 3 20 the date of that election as provided by law. 3 21 EXPLANATION 3 22 This joint resolution proposes an amendment to the 3 23 Constitution of the State of Iowa to provide that members of 3 24 the Iowa house of representatives shall not serve more than 3 25 six terms and members of the Iowa senate shall not serve more 3 26 than three terms. A partial term to which some other person 3 27 was initially elected is not included as an election. The 3 28 limitation on the number of terms and years of service shall 3 29 only apply to terms of office beginning on or after January 1, 3 30 2003. 3 31 The resolution also provides that persons elected to the 3 32 office of governor, lieutenant governor, attorney general, 3 33 secretary of state, auditor of state, and treasurer of state 3 34 are limited to three terms of office. A partial term to which 3 35 some other person was elected or appointed is not included as 4 1 an election. The limitation on the number of terms shall only 4 2 apply to terms of office beginning on or after January 1, 4 3 2003. 4 4 The resolution, if adopted, would be referred to the next 4 5 general assembly before being submitted to the electorate for 4 6 ratification. 4 7 LSB 1433HH 78 4 8 sc/sc/14
