  1  4 RELATING TO AND MAKING TRANSPORTATION AND OTHER INFRA-
  1  5    STRUCTURE-RELATED APPROPRIATIONS TO THE STATE DEPARTMENT
  1  6    OF TRANSPORTATION, INCLUDING ALLOCATION AND USE OF MONEYS 
  1  7    FROM THE GENERAL FUND OF THE STATE, ROAD USE TAX FUND, AND 
  1  8    PRIMARY ROAD FUND, AND INCLUDING FEES FOR CERTAIN REGIS-
  1  9    TRATION PLATES, ALLOWING THE DEPARTMENT TO CONDUCT A PILOT 
  1 10    PROJECT, AND PROVIDING FOR THE NONREVERSION OF CERTAIN 
  1 11    MONEYS, AND PROVIDING AN EFFECTIVE DATE.  
  1 12 
  1 13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 14 
  1 15               STATE DEPARTMENT OF TRANSPORTATION
  1 16    Section 1.  There is appropriated from the general fund of
  1 17 the state to the state department of transportation for the
  1 18 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  1 19 the following amounts, or so much thereof as is necessary, to
  1 20 be used for the purposes designated:
  1 21    1.  For airport engineering studies and improvement
  1 22 projects as provided in chapter 328:  
  1 23 .................................................. $  2,475,000
  1 24    Of the amount appropriated in this subsection, $25,000
  1 25 shall be allocated to the Iowa civil air patrol.
  1 26    2.  For the rail assistance program and to provide economic
  1 27 development project funding:  
  1 28 .................................................. $    662,000
  1 29    Sec. 2.  There is appropriated from the road use tax fund
  1 30 to the state department of transportation for the fiscal year
  1 31 beginning July 1, 2000, and ending June 30, 2001, the
  1 32 following amounts, or so much thereof as is necessary, for the
  1 33 purposes designated:
  1 34    1.  For the payment of costs associated with the production
  1 35 of driver's licenses, as defined in section 321.1, subsection
  2  1 20A:  
  2  2 .................................................. $  2,103,000
  2  3    Notwithstanding section 8.33, unencumbered or unobligated
  2  4 funds remaining on June 30, 2001, from the appropriation made
  2  5 in this subsection, shall not revert, but shall remain
  2  6 available for the following fiscal years for the purposes
  2  7 specified in this subsection.
  2  8    2.  For salaries, support, maintenance, and miscellaneous
  2  9 purposes:
  2 10    a.  Operations and finance:  
  2 11 .................................................. $  5,267,313
  2 12    b.  Administrative services:  
  2 13 .................................................. $    946,149
  2 14    c.  Planning and programming:

  2 18    3.  For payments to the department of personnel for
  2 19 expenses incurred in administering the merit system on behalf
  2 20 of the state department of transportation, as required by
  2 21 chapter 19A:

  2 23    4.  Unemployment compensation:  
  2 24 ................................................... $    17,000
  2 25    5.  For payments to the department of personnel for paying
  2 26 workers' compensation claims under chapter 85 on behalf of
  2 27 employees of the state department of transportation:

  2 29    6.  For payment to the general fund of the state for
  2 30 indirect cost recoveries:  
  2 31 ................................................... $    92,000
  2 32    7.  For reimbursement to the auditor of state for audit
  2 33 expenses as provided in section 11.5B:

  2 35    8.  For costs associated with the county issuance of
  3  1 driver's licenses:

  3  3    9.  For transfer to the department of public safety for
  3  4 operating a system providing toll-free telephone road and

  3  7    10.  For improvements to the scale facilities in Clarke and
  3  8 Worth counties:  
  3  9 ................................................... $   940,000
  3 10    Notwithstanding section 8.33, moneys appropriated in this
  3 11 subsection that remain unencumbered or unobligated at the
  3 12 close of the fiscal year shall not revert but shall remain
  3 13 available for expenditure for the purpose designated until the
  3 14 close of the fiscal year that begins July 1, 2003.
  3 15    11.  For up to the following amount for membership in the
  3 16 North America's superhighway corridor coalition:  
  3 17 .................................................. $     50,000
  3 18    Sec. 3.  There is appropriated from the primary road fund
  3 19 to the state department of transportation for the fiscal year
  3 20 beginning July 1, 2000, and ending June 30, 2001, the
  3 21 following amounts, or so much thereof as is necessary, to be
  3 22 used for the purposes designated:
  3 23    1.  For salaries, support, maintenance, miscellaneous
  3 24 purposes and the following full-time equivalent positions:
  3 25    a.  Operations and finance:

  4 17 adjustment, from the highway materials and equipment revolving
  4 18 fund, shall be expended for salaries and benefits for not more

  4 21 expenses incurred in administering the merit system on behalf
  4 22 of the state department of transportation, as required by
  4 23 chapter 19A:

  5 25    15.  For tuckpointing and repair of the brick exteriors of
  5 26 office buildings and field garage facilities throughout the
  5 27 state:

  5 29    16.  For assistance in purchasing biodegradable hydraulic
  5 30 fluids manufactured from soybeans pursuant to sections 18.22
  5 31 and 307.21:  
  5 32 .................................................. $     15,000
  5 33    17.  For assistance in purchasing biodiesel fuel for use in
  5 34 heavy-duty fleet vehicles of the department:  
  5 35 .................................................. $     20,000
  6  1    Notwithstanding section 8.33, moneys appropriated in
  6  2 subsections 9 through 17 that remain unencumbered or
  6  3 unobligated at the close of the fiscal year shall not revert
  6  4 but shall remain available for expenditure for the purposes
  6  5 designated until the close of the fiscal year that begins July
  6  6 1, 2003.
  6  7    Sec. 4.  Section 321.105, unnumbered paragraph 5, Code
  6  8 1999, is amended to read as follows:
  6  9    Seriously disabled veterans who have been provided with an
  6 10 automobile or other vehicle by the United States government
  6 11 under the provisions of sections 1901 to 1903, Title 38 of the
  6 12 United States Code, 38 U.S.C. } 1901 et seq. (1970), shall be
  6 13 exempt from payment of any automobile registration fee
  6 14 provided in this chapter, and shall be provided, without fee,
  6 15 with a registration plate.  The disabled veteran, to be able
  6 16 to claim the above benefit, must be a resident of the state of
  6 17 Iowa.  The disabled veteran may obtain a special or
  6 18 personalized plate under section 321.34 by paying the
  6 19 difference between the fee for a regular registration plate
  6 20 and the fee for the special or personalized registration
  6 21 plate.
  6 22    Sec. 5.  REFUNDS OF FEES – PILOT PROJECT.  Notwithstanding
  6 23 the obligation to collect a fee for a renewal or duplicate of
  6 24 a nonoperator's identification card or a driver's license
  6 25 pursuant to section 321.190 or 321.191, the state department
  6 26 of transportation may conduct a pilot project for waiving or
  6 27 refunding such fees pursuant to rules adopted by the
  6 28 department.  The department may conduct the pilot project at
  6 29 two driver's license stations in the state.  In conducting the
  6 30 pilot project the department may waive payment of or refund
  6 31 all or a portion of the fees to an applicant for a renewal or
  6 32 a duplicate if the department determines that the service
  6 33 standard for timely issuance has not been met or an error on
  6 34 the license or identification card requires the applicant to
  6 35 return to the driver's license station.  The decision of the
  7  1 department not to issue a refund is final and not subject to
  7  2 review pursuant to the provisions of the Iowa administrative
  7  3 procedure Act in chapter 17A.
  7  4    Sec. 6.  TEMPORARY TRANSFER OF RISE FUND MONEYS.
  7  5 Notwithstanding provisions to the contrary in chapter 315, if
  7  6 the state transportation commission receives and files a
  7  7 letter from the director of transportation certifying that the
  7  8 state department of transportation's cash flow funding may be
  7  9 inadequate to meet anticipated road construction costs which
  7 10 arise during the period beginning on the effective date of
  7 11 this Act through June 30, 2001, the commission may authorize
  7 12 the temporary transfer of funds from the revitalize Iowa's
  7 13 sound economy (RISE) fund to the primary road fund.
  7 14 Transferred funds shall be repaid to the RISE fund within six
  7 15 months of transfer.  The commission shall manage the RISE fund
  7 16 to ensure that funds will be available to meet contract
  7 17 obligations on approved RISE projects.
  7 18    Sec. 7.  EFFECTIVE DATE.  Section 6 of this Act, being
  7 19 deemed of immediate importance, takes effect upon enactment.
