1 1 Section 1. NEW SECTION. 266.47 CENTER FOR EXCELLENCE IN
1 2 FUNDAMENTAL PLANT SCIENCE – DEPOSIT OF MONEYS DERIVED FROM
1 3 RESEARCH RESULTS.
1 4 The results of any research conducted by the center for
1 5 excellence in fundamental plant science established by Iowa
1 6 state university of science and technology, which are subject
1 7 to intellectual property rights, including patent, trademark,
1 8 or copyright, shall be held by the state in the name of Iowa
1 9 state university of science and technology. The university
1 10 may license persons to use the results of the research.
1 11 Licensing fees for such use shall be deposited into the
1 12 excellence in fundamental plant science fund created in
1 13 section 266.48. The university may provide that a person who
1 14 contributed to research pay a reduced licensing fee for the
1 15 use of results of that research.
1 16 Sec. 2. NEW SECTION. 266.48 EXCELLENCE IN FUNDAMENTAL
1 17 PLANT SCIENCE FUND – APPROPRIATION TO THE EXCELLENCE IN
1 18 FUNDAMENTAL PLANT SCIENCE CENTER.
1 19 1. An excellence in fundamental plant science fund is
1 20 created in the state treasury under the control of Iowa state
1 21 university of science and technology.
1 22 2. The fund shall consist of any moneys received by Iowa
1 23 state university or the center for excellence in fundamental
1 24 plant science in license fees as provided in section 266.47 or
1 25 other moneys appropriated by the general assembly for
1 26 placement in the fund, and moneys available to and obtained or
1 27 accepted by the university or the center from the federal
1 28 government or private sources for placement in the fund.
1 29 3. There is appropriated from the fund amounts required by
1 30 the excellence in fundamental plant science center for the
1 31 exclusive purpose of supporting research by the center. The
1 32 treasurer of Iowa state university of science and technology
1 33 shall act as custodian of the fund and disburse amounts
1 34 contained in the fund as directed by the center. The
1 35 treasurer is authorized to invest the moneys deposited in the
2 1 fund as provided in section 12B.10. The income from such
2 2 investment shall be credited to and deposited in the fund.
2 3 Notwithstanding section 8.33, moneys in the fund are not
2 4 subject to reversion to the general fund of the state. The
2 5 finances of the fund shall be calculated on an accrual basis
2 6 in accordance with generally accepted accounting principles.
2 7 The auditor of state shall regularly perform audits of the
2 8 fund.
2 9 EXPLANATION
2 10 This bill relates to research conducted by the center for
2 11 excellence in fundamental plant science which is part of Iowa
2 12 state university of science and technology. The bill provides
2 13 that results of any research conducted by the center subject
2 14 to intellectual property rights is to be held by the state in
2 15 the name of Iowa state university of science and technology.
2 16 The bill provides that the university may license persons to
2 17 use the results of the research. The bill provides that the
2 18 university may provide that a person who contributed to
2 19 research pay a reduced licensing fee for results of that
2 20 research.
2 21 The bill creates an excellence in fundamental plant science
2 22 fund in the state treasury under the control of Iowa state
2 23 university of science and technology. The bill provides that
2 24 moneys received by Iowa state university or the center for
2 25 excellence in fundamental plant science in license fees must
2 26 be deposited in the fund. The bill appropriates moneys from
2 27 the fund required by the center for the exclusive purpose of
2 28 supporting research by the center.
