  1  4 RELATING TO OPERATING WHILE INTOXICATED, INCLUDING
  1  5    IGNITION INTERLOCK PROVISIONS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 321J.2, subsection 2, paragraph a,
  1 10 subparagraph (2), Code Supplement 1999, is amended to read as
  1 11 follows:
  1 12    (2)  Assessment of a fine of one thousand dollars.
  1 13 However, in the discretion of the court, if no personal or
  1 14 property injury has resulted from the defendant's actions, the
  1 15 court may waive up to five hundred dollars of the fine may be
  1 16 waived when the defendant presents to the court at the end of
  1 17 the minimum period of ineligibility, a temporary restricted
  1 18 license issued pursuant to 321J.20.  As an alternative to a
  1 19 portion or all of the fine, the court may order the person to
  1 20 perform unpaid community service.
  1 21    Sec. 2.  Section 321J.17, Code 1999, is amended by adding
  1 22 the following new subsection:
  1 23    NEW SUBSECTION.  3.  The department shall also require
  1 24 certification of installation of an ignition interlock device
  1 25 of a type approved by the commissioner of public safety on all
  1 26 motor vehicles owned or operated by any person seeking
  1 27 reinstatement following a second or subsequent conviction for
  1 28 a violation of section 321J.2, unless such a person has
  1 29 previously received a temporary restricted license as
  1 30 authorized by this chapter.  The requirement for the
  1 31 installation of an approved ignition interlock device shall be
  1 32 for one year unless a different time period is required by
  1 33 statute.
