  1  1    Section 1.  Section 598.21, subsection 1, unnumbered
  1  2 paragraph 1, Code Supplement 1999, is amended to read as
  1  3 follows:
  1  4    Upon every judgment of annulment, dissolution or separate
  1  5 maintenance the court shall divide the property of the parties
  1  6 and transfer the title of the property accordingly, including
  1  7 issuing a quitclaim deed or a change of title for tax purposes
  1  8 and recording with the county recorder of the county where the
  1  9 property is located and assigning payment of the cost of
  1 10 issuance and recording to one or both of the parties.  The
  1 11 court may protect and promote the best interests of children
  1 12 of the parties by setting aside a portion of the property of
  1 13 the parties in a separate fund or conservatorship for the
  1 14 support, maintenance, education, and general welfare of the
  1 15 minor children.  The court shall divide all property, except
  1 16 inherited property or gifts received by one party, equitably
  1 17 between the parties after considering all of the following:  
  1 18                           EXPLANATION
  1 19    This bill requires that, upon the court dividing and
  1 20 transferring property involved in a dissolution of marriage, a
  1 21 quitclaim deed to any real estate be issued and recorded with
  1 22 the county recorder with the court assigning payment of the
  1 23 costs involved in issuing and recording the deed.
