  1  4 PROVIDING FOR THE APPLICATION OF COMPOST MATERIAL TO LAND FOR
  1  5    USE FOR THE PRODUCTION OF ORGANIC AGRICULTURAL PRODUCTS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 200.3, Code 1999, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  15A.  "Organic agricultural product" means
  1 12 the same as defined in section 190C.1.
  1 13    Sec. 2.  Section 200.20, Code 1999, is amended to read as
  1 14 follows:
  1 15    200.20  PHOSPHORIC ACID, NITROGEN AND POTASH REQUIREMENTS.
  1 16    1.  No phosphatic Except as provided in subsection 2, a
  1 17 person shall not sell, offer for sale, or distribute, any of
  1 18 the following:
  1 19    a.  Phosphatic fertilizer containing less than eighteen
  1 20 percent available phosphoric acid (P205), nor any nitrogen.
  1 21    b.  Nitrogen fertilizer containing less than fifteen
  1 22 percent total nitrogen (N), nor any potash.
  1 23    c.  Potash fertilizer containing less than fifteen percent
  1 24 soluble potash (K2O), nor any mixed.
  1 25    d.  Mixed fertilizer in which the sum of the guaranteed
  1 26 analysis of total nitrogen (N), available phosphoric acid
  1 27 (P2O5), and soluble potash (K2O), totals less than twenty
  1 28 percent shall be offered for sale, sold, or distributed in
  1 29 this state.  This section
  1 30    2.  Subsection 1 shall neither not apply to specialty
  1 31 fertilizers as defined in section 200.3, subsection 23, nor to
  1 32 any of the following:
  1 33    a.  A specialty fertilizer.
  1 34    b.  A fertilizer designed to be applied and ordinarily
  1 35 applied directly to growing plant foliage to stimulate further
  2  1 growth.
  2  2    c.  Compost materials to be applied on land, if any of the
  2  3 following apply:
  2  4    (1)  The land is being used to produce an agricultural
  2  5 commodity that is an organic agricultural product as provided
  2  6 in chapter 190C, including rules adopted by the department
  2  7 under that chapter.
  2  8    (2)  The land is in the transition of being used to produce
  2  9 an agricultural commodity that is an organic agricultural
  2 10 product, pursuant to rules adopted by the department as
  2 11 provided in chapter 190C.
